<p>A leader of the United Liberation Movement for West Papua (ULMWP) has called on Indonesian security forces to halt their crackdown on peaceful protest in the wake of this month&#8217;s massacres in Dogiyai and Puncak.</p>
<p>Interim president Benny Wenda accused Indonesian authorities of <a href="https://asiapacificreport.nz/2026/04/24/stop-selling-arms-to-indonesia-west-papuans-urge-netherlands/">suppressing peaceful action</a> in order to &#8220;stoke a cycle of violence in West Papua in order to strengthen their colonial grip over our land&#8221;.</p>
<p>&#8220;intensified militarisation serves Indonesia’s economic interests,&#8221; he <a href="https://www.ulmwp.org/president-wenda-stop-indonesias-crackdown-on-peaceful-protest">said in a statement</a>.</p>

<p>Wenda said the West Papua National Committee (KNPB) had organised &#8220;numerous peaceful demonstrations against Indonesian colonialism&#8221; since the military (TNI) had &#8220;murdered 15 West Papuans in the Puncak massacre&#8221; on April 15.</p>
<p>In response, the TNI and Indonesian police had launched a brutal crackdown, dispersing protesters with water cannons, tear gas, and beatings.</p>
<p>&#8220;The latest crackdown occurred [on April 27], after protesters gathered in front of the Mimika Dormitory in Waena, Jayapura,&#8221; Wenda said.</p>
<p>&#8220;They were met by a heavily armed TNI squadron, who broke up the peaceful protest by firing tear gas canisters and blasting activists with water cannons.&#8221;</p>
<p><strong>Part of strategy</strong><br />
Wenda said violence committed against the KNPB and allied student protesters was part of Indonesia’s strategy in West Papua.</p>
<p>&#8220;By deploying additional troops and establishing new checkpoints, Indonesia protects their investment and creates a pretext for new destructive economic developments,&#8221; his statement said.</p>
<p>&#8220;Chaos and violence are good for business: this is Indonesia’s reason for keeping hold of West Papua,&#8221; he said.</p>
<p>This crackdown demonstrated that democracy did not exist in West Papua.</p>
<p>&#8220;We have never been allowed to peacefully voice our demand for self-determination, whether under the Suharto dictatorship or so-called democratic rule,&#8221; Wenda said.</p>
<p>&#8220;West Papuans will never achieve justice through colonial systems.&#8221;</p>
<p>The ULMWP appealed to solidarity groups and their parliamentary allies to apply pressure on Indonesia to &#8220;stop this crackdown, withdraw their military, and facilitate a visit to West Papua by the UN High Commissioner for Human Rights&#8221;.</p>
<p>&#8220;Our own actions are not enough &#8212; international pressure is the only language Indonesia understands.&#8221;</p>
<p>Indonesian authorities have not responded to these comments by the ULMWP.</p>

<p>At least 20 people were <a href="https://jubi.id/polhukam/2023/gelar-demonstrasi-16-aktivis-knpb-sentani-dipukul-polisi/">wounded when police used batons</a>, water cannon and tear gas to disperse hundreds of people who joined rallies in Indonesia’s West Papua region on the 61st anniversary of an agreement that made the territory part of Indonesia, news agencies report.</p>
<p>The US-brokered 1962 New York Agreement allowed Indonesia to annex the Christian-majority region after the end of Dutch colonial rule, according to a <a href="https://www.ucanews.com/news/police-brutality-leaves-20-hurt-in-indonesias-papua/102287">report in the UCA News</a>.</p>
<p>Riot police attacked peaceful demonstrators in three locations near the provincial capital Jayapura yesterday, alleged Emmanuel Gobay, a Catholic and an official of the Papua Legal Aid Institute.</p>

<p>The demonstrators called on the international community to review the agreement and take action to end ongoing violence and repression in the region, said the report.</p>
<p>&#8220;In fact, they only held peaceful demonstrations,&#8221; said Gobay, who joined one of the rallies.</p>
<p>He stated that more than 20 people were beaten, with one of them later being treated in hospital.</p>
<p>&#8220;One person was seriously injured and was immediately transported to the hospital for treatment,&#8221; he said.</p>
<p><strong>Listening to speeches</strong><br />
Videos and photos obtained by UCA News showed police attacked with water canons and fired tear gas while people were listening to speeches from leaders of the West Papua National Committee (KNPB), the protest organiser.</p>
<p>Gobay said that although the authorities viewed the KNPB as a &#8220;separatist &#8212; pro-independence &#8212; group &#8220;they should have the right to express their opinion&#8221; as guaranteed in the nation’s constitution.</p>
<p>&#8220;Moreover, they submitted an official letter notifying police about the programme beforehand,&#8221; he added.</p>
<p>He condemned the use of water cannon and tear gas on demonstrators.</p>
<p>These should only be for anarchic demonstrations &#8212; &#8220;not peaceful demonstrations,&#8221; he said.</p>

<p>Gobay alleged that police committed criminal offences by torturing and beating protesters, and called on the Papuan police chief to immediately prosecute the perpetrators so that there was a deterrent effect, said the UCA News report.</p>
<p>Father Bernard Baru from the Jayapura Diocese&#8217;s Justice, Peace and Integrity of Creation Commission said that this repressive action was a repetition of the discriminatory treatment of Papuans by the state.</p>
<p><strong>Brutal police action &#8216;normal&#8217;</strong><br />
“In Papua, police actions like this are considered normal. This only deepens discrimination against Papuans,&#8221; he said.</p>
<p>Police officials were not available for comment.</p>
<p>KNPB spokesman Ones Sahuniap issued a statement to condemn the police brutality and claimed those who were beaten suffered serious head injuries and bled profusely.</p>
<p>Suhuniap said the police used rattan and batons to beat and break up the demonstration.</p>
<p>The KNPB simultaneously held demonstrations in Papua and in other parts of Indonesia, asking the United Nations to review the 1962 New York Agreement.</p>
<p>During the rallies, KNPB leaders called the New York Agreement “a violation of human rights of Papuans” sponsored by Indonesia, the Netherlands and the United States and the United Nations.</p>
<p><strong>Not party to agreement</strong><br />
As per the agreement, later added to the agenda of UN General Assembly, the Netherlands agreed to transfer the control of West Papua New Guinea to Indonesia, pending an UN-administered referendum.</p>
<p>The Papuans were not party to the agreement and it paved the way for the 1969 Act of Free Choice, an independence referendum favoring Indonesian rule in Papua whuch was largely regarded as a sham.</p>
<p>Indonesia’s annexation of Papua and use to force to crush dissent sparked an armed pto-indeoendence movement.</p>
<p>Thousands of civilians, soldiers and rebels have been killed and tens of thousands have been displaced due to the conflict in the easternmost region in the past decades.</p>

<p>Indonesia has stepped up its campaign of repression against West Papuans peacefully rallying for full membership of the Melanesian Spearhead Group (MSG), says a Papuan advocacy leader.</p>
<p><a href="https://www.ulmwp.org/">Benny Wenda</a>, interim president of the United Liberation Movement for West Papua (ULMWP), said a &#8220;massive military and police presence&#8221; greeted Papuans who had taken to the streets across West Papua calling for full membership.</p>
<p>In Sorong, seven people were arrested &#8212; not while raising the banned Morning Star flags of independence and shouting Merdeka (&#8220;freedom&#8221;), but for holding homemade placards supporting full membership, according to Wenda.</p>

<p>In Jayapura and Wamena, protesters were chased by security forces, beaten and dragged away into police cars, <a href="https://www.ulmwp.org/">Wenda said in a statement</a>.</p>
<p>During a protest in Dogiyai, 20-year-old <a href="https://kaltimpost.jawapos.com/nasional/16/07/2023/dogiyai-mencekam-69-bangunan-dibakar-2-polisi-dan-1-tentara-terluka">Yosia Keiya was alleged to have been summarily executed</a> by Indonesian police on July 13 while he was peacefully sitting on the roadside.</p>
<p>&#8220;Eyewitnesses reported seeing two police cars arrive in the vicinity and shoot Keiya without provocation,&#8221; Wenda said in the statement.</p>
<p>&#8220;This crackdown follows the mass arrest of KNPB (West Papua National Committee) activists handing out leaflets supporting full MSG membership on July 12.</p>
<p><strong>&#8216;Ocean of violence&#8217;<br />
</strong>&#8220;But Keiya and those arrested are only the latest victims of Indonesia’s murderous occupation &#8212; single drops in an ocean of violence West Papuans have suffered since we rose up against colonial rule in 2019.&#8221;</p>

<p>Both Indonesia and the ULMWP are members of the MSG &#8211; the former as an associate and the ULMWP as an observer.</p>
<p>The full members are Fiji, FLNKS (New Caledonia&#8217;s Kanak and Socialist National Liberation Front), Papua New Guinea, Solomon Islands and Vanuatu.</p>
<p>&#8220;Melanesian leaders must ask themselves: is this how one group member treats another? Is this how a friend to Melanesia treats Melanesians?&#8221; asked Wenda.</p>
<p>&#8220;The fact that they brought an Indonesian flag to the Melanesian Arts Festival in Port Vila, only shortly after their soldiers shot Keiya dead, is an insult.</p>
<p>&#8220;They&#8217;re dancing on top of our graves.&#8221;</p>
<p>Wenda said West Papua was entitled to campaign for full membership by virtue of Melanesian ethnicity, culture, and linguistic traditions.</p>
<p>&#8220;In all these respects, West Papua is undeniably Melanesian &#8212; not Indonesian,&#8221; he said.</p>

<p>&#8220;While Indonesia won its independence in 1945, we celebrated our own independence on December 1, 1961. Our separateness was even acknowledged by Indonesia’s first Vice-President Mohammed Hatta, who argued for West Papuan self-determination on this basis.</p>
<p>&#8220;More than anything, this crackdown shows how much West Papua needs full membership of the MSG.</p>
<p>&#8220;Right now, we are defenseless in the face of such brutal violations; only as a full member will we be able to represent ourselves and expose Indonesia’s crimes.</p>
<p>&#8220;West Papuans are telling the world they want full membership. By coming out onto the streets with their faces painted in the colours of all the Melanesian flags, they are saying, &#8216; We want to return home to our Melanesian brothers and sisters, we want to be safe.&#8217; It is time for Melanesian leaders to listen.&#8221;</p>
<p>The MACFEST 2023 &#8212; the Melanesian Arts and Culture Festival &#8212; ends in Port Vila today.</p>
<p>The MSG meeting to decide on full membership is due to be held soon although the dates have not yet been officially set.</p>

<p>The Melanesian Spearhead Group (MSG) Leaders Summit proposed to be held from yesterday until July 21 has been postponed to another date, which is yet to be confirmed.</p>
<p>This was confirmed by Foreign Affairs Minister and Deputy Prime Minister Jotham Napat.</p>
<p>He said the MSG Foreign Affairs Ministers Meeting had last month proposed this date pending confirmation from each member country.</p>

<p>Napat said the government of Solomon Islands noted there was a clash with the sitting of Parliament and asked for the meeting to be rescheduled.</p>
<p>“Vanuatu’s Prime Minister [<span class="ILfuVd" lang="en"><span class="hgKElc">Ishmael Kalsakau</span></span>] as Chair of the MSG will write to the members for them to reschedule the meeting on another date where every leaders are available to complete their issues,” he told the <em>Vanuatu Daily Post.</em></p>
<p>“For Vanuatu, July is already full of activities. The President of France is arriving soon. We are looking at organising the meeting in August.”</p>
<p>Asked to confirm whether the endorsement of the United Liberation Movement for West Papua (UMLWP) as a full member of MSG was going to be on the agenda at this Leaders&#8217; Meeting, Napat replied that this had not been discussed at the MSG Foreign Affairs Minister Meeting.</p>
<p><strong>Budget only discussed</strong><br />
He explained that the Foreign Affairs Minister Meeting discussed only the budget and its approval.</p>
<p>However, the application for UMLWP full membership would be discussed in a retreat by the MSG Prime Ministers before any adoption.</p>
<p>Vanuatu has been strongly supporting this agenda.</p>
<p><em>The Jakarta Globe</em> reported that Foreign Affairs Minister Napat had discussed the possibility of Vanuatu opening an embassy in Indonesia with his Indonesian counterpart during his visit there last month.</p>
<p>He said he told his counterpart about Vanuatu’s push for West Papua to be part of MSG.</p>
<p>“Indonesia has been very frank about this matter. They consider West Papua as part [of Indonesia] and they told us that we [Vanuatu] are undermining their sovereignty.</p>
<p>“This does not stop us to keep pushing this agenda to the MSG Leaders to decide on it. It’s a sensitive issue that needs to be agreed by all leaders.</p>
<p>&#8220;Every decision is to be taken by consensus, it will be very difficult if some of the leaders are reluctant to support the agenda,” he said.</p>
<p>Indonesia has been providing scholarships for Papua New Guineans and Fijians to study abroad.</p>
<p><strong>Vanuatu&#8217;s push for West Papua</strong><br />
Asked if such assistance could jeopardise Vanuatu’s push for West Papua, Minister Napat said: “Vanuatu is a sovereign country and it must decide on its own destiny and future.</p>
<p>“It is the same for PNG, it has its own sovereign right.</p>
<p>&#8220;Somewhere we have to find what is our interest, whether we continue pursuing the idea or we decide on a different path but continue advocate.</p>
<p>“You cannot be shouting from outside. You have to sit at the roundtable with them and talk so that they can hear you.</p>
<p>&#8220;It’s an interest for Vanuatu to pursue the matter, but when it comes to MSG its a collective decision.”</p>

<p>An Australian advocacy group for West Papua self-determination has condemned yesterday&#8217;s arrest by Indonesian security forces of 10 West Papua National Committee (KNPB) members.</p>
<p>The activists were arrested &#8220;simply because they were handing out leaflets informing people of a rally to be held today&#8221; to show support for West Papua becoming a full member of the Melanesian Spearhead Group (MSG), said the Australia West Papua Association (AWPA) in a statement.</p>
<p>The security forces detained the activists and took them to the Jayapura Resort Police station in Sentani for questioning.</p>

<p>They were eventually released after being detained for eight hours.</p>
<p>It was reported that the police were threatening the KNPB activists and asking therm to make a statement not to carry out West Papuan independence struggle activities.</p>
<p>“Yet again we have peaceful activists arrested for simply handing out leaflets about an upcoming rally, which is their right to do under the UN&#8217;s Universal Declaration of Human Rights,” said Joe Collins of AWPA:</p>
<p><em>Article 19</em><br />
<em>Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.</em></p>
<p><em>Article 20</em><br />
<em>1. Everyone has the right to freedom of peaceful assembly and association.</em></p>
<p>“Hopefully any rallies that take place today will be allowed to go ahead peacefully and there will not be a repeat of the brutal crackdowns that occurred at other peaceful rallies in the past.”</p>
<p>The Melanesian Spearhead Group is due to meet in Port Vila, Vanuatu, this month, although the dates have not yet been announced.</p>
<p>The MSG consists of Fiji, Papua New Guinea, Solomon Islands, Vanuatu and the Kanak and Socialist National Liberation Front (FLNKS) of Kanaky (New Caledonia).</p>
<p>West Papua has observer status while Indonesia has associate membership and Jakarta has been conducting an intense diplomatic lobbying with MSG members over recent months.</p>
<p>The United Liberation Movement of West Papua (ULMWP) has applied for full membership.</p>

<p>Amnesty International is calling on Indonesia to release West Papua National Committee (KNPB) international spokesperson <a href="https://asiapacificreport.nz/?s=Victor+Yeimo">Victor Yeimo</a>.</p>
<p>Yeimo was sentenced on Friday to <a href="https://www.amnesty.id/free-victor-yeimo-and-other-imprisoned-papuan-activists-unconditionally/">eight months in prison</a> for his involvement in an anti-racism protest in Papua in August 2019.</p>
<p>In a statement, Amnesty International is calling for the immediate and unconditional release of Yeimo and all Papuans imprisoned for peacefully expressing their political opinions.</p>

<p>Amnesty Indonesia executive director Usman Hamid said the arbitrary arrest and detention of Victor Yeimo and many other Papuans was discriminatory and constituted a failure of the Indonesian state to uphold and protect the democractic and human rights of its citizens.</p>
<p>&#8220;The fact that he and many Papuans have been arrested and detained for peacefully expressing their political opinion represents the state&#8217;s neglect on human rights protection,&#8221; he said.</p>
<p>Hamid said data collected between 2019 and 2022 indicates an alarming escalation in efforts to silence and intimidate Papuan activists in Indonesia with at least 78 people facing criminal charges and prosecution for allegedly violating treason articles under the Penal Code.</p>
<p>Carolyn Nash, Asia advocacy director at Amnesty USA, said human rights were under attack in the autonomous region.</p>
<p><strong>&#8216;Escalating efforts to silence Papuans&#8217;</strong><br />
&#8220;These escalating efforts to silence and intimidate Papuan activists should alarm the US government, which has repeatedly looked to Indonesia as a regional example of democratic norms commitment to human rights principles,&#8221; she said.</p>
<p>&#8220;But the reality is clear: these human rights principles are under attack.</p>
<p>&#8220;The treatment of Papuan activists is the measure by which the US can assess the Indonesian government&#8217;s commitment to protect free expression &#8212; and the Indonesian government is demonstrating how weak that commitment truly is.&#8221;</p>
<p>Previously, West Papua Action Aotearoa spokesperson Catherine Delahunty said <a href="https://www.rnz.co.nz/international/pacific-news/462422/calls-for-nz-govt-to-condemn-charges-against-west-papuan-activist">Yeimo&#8217;s only crime</a> had been to stand up against the abuse of West Papuan students in Indonesia.</p>
<p>In March, a West Papuan advocacy group claimed <a href="https://www.rnz.co.nz/international/pacific-news/487064/papuan-group-says-20-arrested-for-vanuatu-cyclone-fundraising">20 Papuans who were fundraising for the victims of tropical cyclones in Vanuatu</a> were arrested by Indonesian police in the provincial capital Jayapura.</p>

<p>A West Papuan leader, defending himself against treason charges, has denounced &#8220;systemic racism&#8221; by Indonesian authorities in the Melanesian region in a court hearing.</p>
<p>Viktor Yeimo, the international spokesperson of the West Papua National Committee (KNPB), presented his defence statement &#8212;<em> pledoi</em> &#8212; in a hearing at the Jayapura Class 1A District Court in Papua Province last Thursday.</p>
<p>He claimed that the treason charge against him was discriminatory and had political undertones.</p>

<p>Yeimo also argued that the trial conducted at the Jayapura District Court had failed to provide evidence of any wrongdoing or violation of the law &#8212; let alone treason &#8212; on his part.</p>
<p>The <a href="https://en.jubi.co.id/public-prosecutor-charges-viktor-yeimo-with-treason/">accusation of treason against Yeimo</a> was linked to his alleged involvement in the anti-racism protests in Jayapura City on August 19 and 29, 2019.</p>
<p>These protests were made to <a href="https://en.jubi.id/one-more-expert-witness-declares-anti-racism-protest-and-referendum-demand-not-treasonous/">condemn derogatory remarks</a> made towards Papuan students at the Kamasan III Student Dormitory in Surabaya on August 16, 2019.</p>
<p>On August 12, 2021, the Jayapura District Court registered the alleged treason case under the case number 376/Pid.Sus/2021/PN Jap. The trial was presided over by chief judge Mathius and member judges Andi Asmuruf and Linn Carol Hamadi.</p>
<p><strong>Witnesses &#8216;proved innocence&#8217;</strong><br />
When reading his defence statement, Yeimo said that all witnesses presented by the prosecutor had actually proven the fact that he did not plan or coordinate the demonstrations against Papuan racism that took place in Jayapura City.</p>

<p>“At the August 19, 2019 action, I participated as a participant in the action against racism, and took part in securing the peaceful action at the request of students until it was over,” Yeimo said.</p>
<p>During the hearing, Yeimo argued that the witnesses produced by the prosecutor had actually corroborated his innocence. Their testimony had shown that he did not organise the protests in question.</p>
<p>Yeimo maintained that he had simply participated in the protests as a supporter of the cause and had helped ensure their peaceful conduct.</p>
<p>“During the protest on August 19, 2019, I merely acted as a participant and helped maintain a peaceful demonstration until it ended,” Yeimo said in his defence.</p>
<p>Yeimo highlighted the testimony of Feri Kombo, the former head of the Cenderawasih University Student executive board in 2019, who affirmed that Yeimo was not involved in the planning or coordination of the anti-racism protests.</p>
<p>Kombo was summoned as a witness on February 7, 2023, and testified that Yeimo had only given a speech at the event when requested by the protesters, and that the speech was intended to maintain order among them.</p>
<p><strong>Delivered speeches</strong><br />
“I delivered speeches expressing my disappointment with the acts of racism in Surabaya. This aspiration is protected by the country’s laws as a constitutional right,&#8221; Yeimo said.</p>
<p>&#8220;As stated by the state administration expert witness and the philosophy expert witness, this right has a scientific basis.”</p>
<p>In addition, Yeimo stressed that he had never been involved in participating, let alone planning, in the protest that occurred on August 29, 2019, which was confirmed by all the witnesses presented in the trial.</p>
<p>Yeimo admitted that he had taken photos and videos in front of the Papuan People’s Assembly (MRP) office and the Governor’s Office, but did not join the protest.</p>
<p>Yeimo clarified that he captured photos and videos to share with journalists and the public outside of Papua since the internet network was cut off by the central government at the time.</p>
<p>He added that President Joko Widodo had been found guilty of unlawful acts by a judge in the State Administrative Court in relation to the internet blackout.</p>
<p><strong>Response to racism<br />
</strong>Yeimo said that the anti-racism demonstration was a spontaneous action taken by both Papuan and non-Papuan people in response to the racial insults that had been directed at Papuan students in Surabaya.</p>
<p>“The 2019 anti-racism protest that spread throughout Papua was a spontaneous response by Papuans and non-Papuan sympathizers from various backgrounds including private sector workers, students, farmers, military and police, and others.</p>
<p>&#8220;Everyone was reacting to the racist remarks in Surabaya. The demonstration in Jayapura was organised by students and the Cipayung group, and there was no planning, conspiracy, or treason as alleged.</p>
<p>&#8220;My speech was to represent the Papuan people who felt outraged by the racist insults. I deny all accusations that link me to my organizational background and other activities that have no direct connection to the facts of the anti-racism protest,” Yeimo said.</p>
<p>Yeimo stated that during the protest on August 19, 2019, he spoke about the issue of racism and discrimination in Indonesia. He emphasised that these problems were not merely personal issues but rather systematic problems that were perpetuated for the benefit of the ruling economic powers.</p>
<p>“It is evident that racist views have led to Papuans being treated differently in all aspects of their lives. The negative stigma attached to Papuans is what led the mass organisation and state apparatus to attack the Papuan Student Dormitory in Surabaya.”</p>
<p>In his statement, Yeimo’s arguments revolved around the issue of racial discrimination that Papuans have faced and how it is seen as a normal occurrence that the State tolerates.</p>
<p><strong>Papuans standing up to injustices</strong><br />
He highlighted that when Papuans stood up against these injustices, they were met with accusations of provocation and charged with treason.</p>
<p>“This trial case proves it. Racism really exists in all these accusations and charges. Could the State explain why the Papuan race is a minority, with only 2.9 million people remaining, while in Papua New Guinea there are already 17 million Papuans?” Yeimo asked.</p>
<p>In his <em>pledoi</em>, Yeimo not only defended himself against the treason allegations but also criticised Indonesia’s lack of development in Papua.</p>
<p>He raised questions about why the poverty rate in Papua remained the highest among all provinces in Indonesia and why the Human Development Index in the region had consistently been the lowest.</p>
<p>Yeimo pointed out the contrasting approaches taken by the Indonesian government in resolving the conflict in Aceh and in Papua.</p>
<p><strong>Differences with Aceh</strong><br />
While the Aceh conflict was resolved through peace talks, Papua’s aspirations for independence have been met with violence and imprisonment.</p>
<p>Yeimo questioned why the government treats the two regions so differently.</p>
<p>Yeimo said that although Indonesia had enacted several laws to address issues of discrimination, freedom of expression, and special autonomy for Papua, these laws do not seem to be enforced in Papua, and their implementation did not benefit the indigenous Papuans.</p>
<p>“Isn’t that a structured crime against us Papuans? Can the government answer these questions? Or do the answers have to come from the muzzle of a gun?&#8221; asked Yeimo.</p>
<p>&#8220;Why is the government avoiding solutions recommended by state institutions such as the Indonesian Institute of Sciences, the National Research and Innovation Agency, and others who present the studies on Papua problems?”</p>
<p><strong>Linguist witness competence in Yeimo’s trial questioned<br />
</strong>During the hearing, Viktor Yeimo&#8217;s legal team, represented by the Papua Law Enforcement and Human Rights Coalition, presented a defence read by advocate Emanuel Gobay.</p>
<p>Gobay argued that the prosecutor’s conclusion that Yeimo had committed treason relied solely on the testimony of a linguist witness who lacked the necessary expertise to prove the elements of the crime of treason as outlined in Article 106 jo Article 55 paragraph (1) to 1 of the Criminal Code, which Yeimo had been charged with.</p>
<p>“As a matter of fact, during the trial, the prosecutor never presented a criminal expert witness. Instead, the prosecutor relied on a linguist and then concluded that Viktor Yeimo was guilty of treason,” said Gobay.</p>
<p>According to Gobay, Yeimo’s legal team had presented multiple expert witnesses who explained the components of the treason offence, which included the elements of intent, territorial separation, and participation.</p>
<p>“All elements mentioned in Article 106 are not proven based on the testimony of both the prosecutor’s witnesses and the expert witnesses we presented,” Gobay said.</p>
<p>Gobay expressed the hope that the judges would review all the facts presented in Yeimo’s trial.</p>
<p>He asked the judges to re-examine the data provided by legal philosophy expert Tristam Pascal Moeliono, human rights expert Herlambang P Wiratraman, conflict resolution expert in Papua Cahyo Pamungkas, and criminal law expert Amira Paripurna.</p>
<p>Ultimately, Gobay made a plea to the judges to exonerate Viktor Yeimo, stating there was no proof of the alleged offences.</p>
<p>He requested restoration of Yeimo’s reputation and the State to bear the trial costs.</p>

<p>Amnesty International Indonesia and Amnesty International Australia have condemned the repression used against the people in West Papua when they were commemorating Human Rights Day yesterday &#8212; December 10, which marks the signing of the Universal Declaration of Human Rights.</p>
<p>Indonesian authorities made 116 arrests and injured at least 17 people during multiple forced dispersals of rallies in the lead up to and during December 10 in four regencies across West Papua.</p>
<p>“We are appalled to hear about these mass arrests. Many were arrested when the rally had not even started,&#8221; Amnesty International Indonesia executive director Usman Hamid said.</p>

<p>&#8220;This shows Indonesian authorities’ utter disregard of West Papuans’ right to peaceful assembly.</p>
<p>“Criminalising them for simply peacefully exercising such right will only breed further resentment and distrust. That discriminatory treatment against them has to stop,” said Hamid.</p>
<p>“People all over the globe commemorated Human Rights Day. The fact that West Papuan people could not enjoy the same right, shows that there is a human rights emergency in West Papua.&#8221;</p>
<p>Amnesty International Australia national director Sam Klintworth said: &#8220;Australia needs to demand accountability from Indonesian authorities, especially as they are recipients of so much Australian aid.”</p>
<p><strong>23 arrested in Wamena</strong><br />
On December 8, 23 people in Wamena were arrested for several hours when they were distributing leaflets for people to join the Human Rights Day rally.</p>
<p>On December 10, forced dispersals and mass arrests took place in Wamena and Jayapura.</p>
<p>In Jayapura, 56 people were arrested and at least 16 people were known to be injured during forced dispersals in multiple locations.</p>
<p>In Wamena, 37 people were arrested and at least one person was injured when the multiple rallies were forcibly dispersed.</p>
<p>Also on December 10, a rally in Sorong was forcibly dispersed, and the protest in Manokwari was blocked by police.</p>
<p>Most of the protesters were members of the West Papua National Committee (Komite Nasional Papua Barat – KNPB), a peaceful grassroots organisation campaigning for the right to self-determination.</p>
<p>Article 19 of the International Covenant on Civil and Political Rights (ICCPR), which Indonesia has ratified through Law No. 12/2005, explicitly guarantees the right of any person to hold opinions without interference.</p>
<p>Freedom of peaceful assembly is also guaranteed under Article 21 of the ICCPR.</p>
<p>Amnesty International does not take any position regarding political status within Indonesia, including calls for independence.</p>
<p>However, the organisation believes that the right to freedom of expression includes the right to peacefully advocate for independence referenda, or other political positions.</p>

<p>Andrefina Karma asked people not to protest over the death of her father.</p>
<p>Human rights watch researcher <a href="https://podcast.radionz.co.nz/pacn/dateline-20221103-0602-west_papua_mourns_the_passing_of_filep_kama-128.mp3">Andreas Harsono told RNZ <em>Pacific Waves</em></a> Karma was a master diver and had dived regularly at the same beach.</p>
<p>Harsono said Karma often encountered problems at sea.</p>
<p>He said that on the day of his death he was with two relatives and they were swimming together. The relatives went home as Karma wanted to fish alone, which Harsono said was dangerous for a diver.</p>
<p><b>Suspicions mount<br />
</b>However, some Papuan activists want a full investigation into the death.</p>
<p>West Papua National Committee (KNPB) activist Ogram Wanimbo, said the complete chronology of Filep Karma&#8217;s death must be revealed transparently to the public.</p>
<p>Wanimbo said they were dissatisfied with the post-mortem results.</p>
<p>&#8220;We need an explanation of who went to the beach with him and what exactly happened,&#8221; he said.</p>
<p>Papuan People&#8217;s Petition spokesperson Jefri Wenda also asked for a more detailed explanation.</p>
<p>The chairman of the Papua Customary Council, Dominikus Surabut, said his party also did not fully believe that Filep Karma&#8217;s death was purely an accident.</p>
<p>&#8220;The family said it was a pure accident but until now, I don&#8217;t believe it. Let there be an investigation into it,&#8221; Surabut said.</p>
<p>Indonesian human rights lawyer Veronica Koman said: &#8220;There were too many strange circumstances around his death and questioning police&#8217;s influence on the family. We are not accepting this as an accident.&#8221;</p>

<p>Papua Legal Aid Foundation (LBH) director Emanuel Gobay says a participant of a demonstration in Jayapura opposing the creation of new autonomous regions (DOB) in Papua is in a critical condition after being shot by a rubber bullet allegedly fired by a police officer.</p>
<p>Earlier, police forcibly broke up a demonstration opposing new autonomous regions in Papua.</p>
<p>&#8220;Yes [the critical injury] was at an action in Waena,&#8221; said Gobay when contacted by CNN Indonesia.</p>

<p>Although Gobay said he did not know the exact chronology of events leading up to the shooting, he confirmed that the victim was taking part in an action in front of Mega Waena department store in Jayapura.</p>
<p>&#8220;So right when they arrived in front of Mega Waena [the protest] was forcibly broken up, it was at this time that police used rubber bullets and the like. When a rubber bullet was fired it hit one of the protesters,&#8221; he said.</p>
<p>According to Gobay, the victim was immediately taken to a Mimika boarding house for treatment by students. He did not have any further information on the victim&#8217;s condition.</p>
<p>Gobay added that aside from the person shot by a rubber bullet, another participant suffered injuries after being assaulted by police.</p>
<p><strong>Kicked in the chest</strong><br />
He said the victim was kicked in the chest by a police officer.</p>
<p>&#8220;This person ended up unconscious, then they were picked up and taken to the boarding house. Earlier I managed to meet with them, they complained that their chest still hurt because of being kicked. There were several others who were injured,&#8221; said Gobay.</p>

<p>Demonstrations against the creation of new autonomous regions and Special Autonomy (Otsus) in several parts of Jayapura were forcibly broken up by police on Tuesday.</p>
<p>One incident, in which police forcibly broke up a peaceful action using a water cannon, was recorded on video and shared on Twitter by Papuan People&#8217;s Petition (PRP) spokesperson Jeffry Wenda.</p>
<p>At least seven people were arrested by police during the action, including Wenda, West Papua National Committee (KNPB) spokesperson Ones Suhuniap and Omizon Balingga.</p>
<p>Police have yet to provide detailed information on the person shot by the rubber bullet.</p>
<p>So far they have only announced that they sized a number of pieces of evidence in the form of sharp weapons and materials with the banned <em>Morning Star</em> independence flag motif on them, which were confiscated during a sweep of demonstrators in the Sentani area of Jayapura regency.</p>

<p>The West Papua National Committee (KNPB) has declared that it rejects the violent approach which Indonesia continues to push in the land of Papua.</p>
<p>&#8220;We have been consistent in the demand to resolve the political conflict in Papua peacefully. We reject a violent approach which has already claimed many victims since [Papua] was annexed [by Indonesia] in 1962,&#8221; said KNPB spokesperson Ones Suhuniap in a media release this week.</p>
<p>&#8220;We are aware that weapons will not resolve the Papua problem.&#8221;</p>

<p>The KNPB is asking the Free Papua Movement-West Papua National Liberation Army (TPNPB OPM) and the Indonesian government to halt the armed conflict.</p>
<p>&#8220;Immediately open up peaceful democratic space for dialogue and to find a find a peaceful solution,&#8221; the group said.</p>
<p>According to Suhuniap, the KNPB is asking Indonesia to stop sending troops to the land of Papua.</p>
<p>&#8220;We are asking Jakarta to withdraw the troops which have been dropped [in Papua] in huge numbers because this has impacted on humanitarian crimes since 1962.</p>
<p><strong>&#8216;Don&#8217;t sacrifice people&#8217;</strong><br />
&#8220;Immediately pursue a political solution. Don&#8217;t sacrifice people for the sake of the economic and political interests of the oligarchy in Jakarta.</p>
<p>&#8220;Members of the TNI [Indonesian military] and Polri [Indonesian police] are also human beings. Likewise, the TPNPB are also human beings,&#8221; the group said.</p>
<p>As an organisation, the KNPB rejects the use of arms as a solution.</p>
<p>&#8220;All KNPB members adhere to the KNPB&#8217;s principles of struggling peacefully without violence. We need to remind all rogue individuals (<em>oknum</em>) and other parties to stop treating the KNPB as criminals.</p>

<p>&#8220;If there are such rogue individuals they must be held accountable for their actions. We will not tolerate it anymore,&#8221; said Suhuniap.</p>
<p>Suhuniap believes that the bloody conflict which is continuing in the land of Papua is a consequence of Jakarta&#8217;s reluctance to resolve the conflict peacefully.</p>
<p>&#8220;All the Papuan people want is their political right to be respected as a nation. So, right from the start the KNPB has demanded a referendum as a peaceful solution for the Papuan people.</p>
<p>intentionally cultivated crimes<br />
&#8220;So far this has not happened, because Jakarta has intentionally cultivated and maintained crimes against humanity in the land of Papua,&#8221; he explained.</p>
<p>Suhuniap continued: &#8220;Papua&#8217;s problems are very clear. Indonesia and the world also understands this.</p>
<p>&#8220;Our political history and the current reality proves that the Papuan people have, are and will continue to be the victims. All of the scientific research proves this. So as human beings we need a peaceful solution.&#8221;</p>
<p>In heading towards the peaceful solution that is yearned for, said Suhuniap, both parties needed to speak at an respectable location.</p>
<p>&#8220;And speak honestly and openly, then agree on a solution for the Papuan people.&#8221;</p>
<p>Because of this, the KNPB as a media for the Papuan people was continuing to urge Jakarta and all other parties to pursue a peaceful solution.</p>
<p><strong>Papuan lives without hope</strong><br />
Meanwhile, KNPB diplomatic secretary Omikson Balingga said that the lives of the Papuan people in Indonesia had been without hope because of the unfolding threat of violence over the past 60 years.</p>
<p>&#8220;The Papuan nation does not have any hope living with a colonial country. Aside from its people, the natural resources of the land of Papua also continue to be exhausted by Indonesia. The only solution is independence as a sovereign country&#8221;, he said.</p>
<p>Earlier, KNPB General Chairperson Warpo Sampari Wetipo declared that the KNPB as a media of the West Papuan people has been consistent in its civilian mission in the cities.</p>
<p>&#8220;The KNPB will never retreat a single step. The KNPB has been constant in the agenda of self-determination which along with the Papuan people it has continued to struggle for&#8221;, said Wetipo.</p>
<p>As long as the Papuan people are still not given the democratic space to determine their own future (self determination), he asserted that the KNPB will continue to exist throughout the land of Papua.</p>
<p>&#8220;To this day the struggle of the Papuan nation has been to demand political independence. This is no longer a secret. All of the Papuan people already know and understand our political history and what is best for the future&#8221;.</p>
<p>Wetipo stated that Indonesia must understand that it has to stop using colonialist policies and actions against the Papuan people.</p>

<p>The above was written by West Papua National Committee KNPB national spokesperson Ones Suhuniap in his notes in the lead up to the 13th anniversary of the KNPB on Friday.</p>
<p>&#8220;Attempts at criminalisation since 2009 until now in 2021 are still being continued through the TNI and Polri,&#8221; wrote Suhuniap.</p>
<p>The first challenge, he said, was the first coordination post at the grave of assassinated independence leader Theys Hiyo Eluay in Sentani, Jayapura regency, which was forcibly dismantled by Indonesian security forces on the orders of the Jayapura regent at the time.</p>

<p>&#8220;Because the fist coordinating post was dismantled on December 30, 2008, in the end the KNPB established the Papua task force headquarters near Bapak [Mr] Theys Eluay&#8217;s grave,&#8221; he said.</p>
<p>Following this in 2009, the KNPB was listed by the government as a &#8220;terrorist&#8221; and &#8220;criminal&#8221; organisation.</p>
<p>&#8220;Australian academic Dr Jason MacLeod clarified that the KNPB was a civil movement organisation conducting a peaceful urban struggle. In the end, the KNPB&#8217;s status as a terrorist and criminal organisation was removed,&#8221; said Suhuniap.</p>
<p><strong>Activists on &#8216;wanted&#8217; list</strong><br />
When it was declared a terrorist and criminal organisation, all of the KNPB&#8217;s activists were put on the police wanted persons list (DPO). As a consequence, they all sought refuge in the forests, on Abe Mountain, some even hid in Sabron, Jayapura.</p>
<p>&#8220;In the forests on Abe Mountain, the KNPB held its first mass consultation (Mubes) in the jungle,&#8221; he said.</p>

<p>A year later, in 2019, Suhuniap said that the KNPB began promoting its first congress which was eventually held in Sentani.</p>
<p>&#8220;The congress gave birth to three resolutions, including diplomatic unity, Papuan military unity and civilian unity through representative institutions,&#8221; he said.</p>
<p>Attempts at criminalisation did not, however, end. In 2021 the KNPB was again accused of being an anarchist and criminal organisation.</p>
<p>&#8220;Several criminal actions which were part of a plot were concocted, and then KNPB&#8217;s chairperson Mako M Tabuni was shot dead by members of the Special Forces (Kopassus) and the Indonesian police at the State Housing Company (Perumnas) 3 complex in Waena. Then Hubertus Mabel was killed by the Indonesian military in Wamena.&#8221;</p>
<p>Suhuniap revealed: &#8220;The state through the security forces pushed through a proposal and proposed to the DPRP [Papua Regional House of Representatives], the DPR [House of Representatives] and the Mendagri [Ministry of Home Affairs] that they hold a plenary session to disband the KNPB after the murder of its chairperson and deputy chairperson.&#8221;</p>
<p><strong>Extraprdinary congress</strong><br />
In the same year, despite pressure from the military, the KNPB held an extraordinary congress (KLB) in Timika.</p>
<p>&#8220;In 2016 the Papua regional police issued a proclamation prohibiting the KNPB from holding demonstrations and proposed to the central government that the KNPB be immediately disbanded,&#8221; said Suhuniap.</p>
<p>None of these efforts by the state made the KNPB retreat a single step.</p>
<p>Quite the opposite, said Suhuniap, the KNPB defied the regional police&#8217;s proclamation by occupying the Papua Mobile Brigade (Brimob) Command Headquarters in Kotaraja on May 1, 2016.</p>
<p>Despite ongoing mental terror and repression by the security forces and their accomplices, in 2018 the KNPB aggressively built a consolidation until it succeeded in holding the 2nd Congress at the Vietnam Village in the State Housing Company 3 Complex.</p>
<p>&#8220;The second congress gave birth to a political resolution, namely a national civil strike (MSN),&#8221; said Suhuniap.</p>
<p>In 2021 the KNPB was criminalised by blaming them for attacks committed by the West Papua National Liberation Army (TPNPB) and incessant propaganda by buzzers accusing the KNPB of wanting to thwart the 20th National Games in Papua.</p>
<p><strong>Accusations &#8216;just nonsense&#8217;</strong><br />
&#8220;These accusations were just nonsense, because they were indeed not proven,&#8221; he said.</p>
<p>Finally, he said, last week plain clothes police arrived at the home of a resident in the Expo Waena area after hearing that KNPB activists were eating a meal together.</p>
<p>In the first incident on November 9, police arrived at the home of KNPB general chairperson Agus Kossay who was eating a meal. In the second, on November 13, police returned to the same location and, according to Suhuniap, raided local residents&#8217; homes.</p>
<p>&#8220;Efforts at criminalisation, propaganda and plots which continue to be played out by the colonialists against the KNPB have made us stronger, more confident and even more mature in confronting the challenges of the struggle for West Papua,&#8221; said Suhuniap.</p>
<p>&#8220;None of these efforts have made the KNPB retreat from the struggle, rather what has been done by Indonesia against the KNPB has provided the strength to maintain the struggle for West Papua national liberation.&#8221;</p>
<p>KNPB chairperson Warpo Sampari Wetipo said that the KNPB as a media of the West Papuan ordinary people continued to be consistent in its mission of urban civil struggle.</p>
<p><strong>Right to self-determination</strong><br />
&#8220;Regardless of the attempts and actions by Indonesian security forces against the KNPB it has never broken our spirit of struggle. The KNPB believes in the agenda of the right to self-determination which has been fought for up until now,&#8221; he said.</p>
<p>Wetipo said: &#8220;For as long as the Papuan people are not given the democratic space to determine their own future (self-determination), the KNPB will continue to exist throughout the land of Papua.</p>

<p>Papuan activist Victor Yeimo has been receiving medical treatment in hospital following a police crackdown on a protest in the provincial capital Jayapura demanding that he be released from detention to be treated for illness.</p>
<p>Hundreds of protesters had gathered at the Papua chief public prosecutor&#8217;s office on Monday to demand that West Papua National Committee (KNPB) spokesperson Yeimo be released from detention to be given hospital treatment.</p>
<p>Yeimo&#8217;s detention was finally deferred on Monday afternoon and he was taken to Jayapura public hospital for treatment.</p>

<p>The protesters arrived from the direction of Abepura, Jayapura city. They arrived at the chief public prosecutor&#8217;s office and began giving speeches on the street leading into the office.</p>
<p>In speeches, the demonstrators demanded that chief public prosecutor Nikolaus Kondomo immediately defer Yeimo&#8217;s detention.</p>
<p>Yeimo is currently being tried at the Jayapura District Court in a criminal case related to anti-racist demonstrations in Papua in 2019.</p>
<p>On Friday, August 27, the panel of judges, presided over by Eddy Soeprayitno S Putra, with judges Mathius and Andi Asmuruf, ruled that Yeimo&#8217;s detention be <a href="https://asiapacificreport.nz/2021/08/29/indonesian-court-orders-hospital-treatment-for-accused-papuan-activist-victor-yeimo/">deferred and that he receive medical treatment because he was ill</a>.</p>
<p><strong>Demand for treatment</strong><br />
The rally at the prosecutor&#8217;s office on Monday was because Yeimo had still not been released from detention. They demanded that the prosecutor release Yeimo immediately and allow him to be treated.</p>
<p>The police had already closed the main gate to the office and prohibited the protests from entering the grounds. About 1 pm police forcibly broke up the rally which was coordinated by the KNPB.</p>
<p>A number of protesters were injured, including Gad Holanue, Varra iyaba, Hengki Giban, Leti Soll, Egenius Tebay and Jufri Dogomo. Three protesters &#8212; Soleng Soll, Beni Orsa and Bayage &#8212; were arrested by police.</p>
<p>Papua Regional House of Representatives (DPRP) member John NR Gobai said he deplored the police actions. Gobai, along with DPRP member Laurenzus Kadepa, had been accepted by the court as guarantors for Yeimo to be released and treated in hospital.</p>
<p>&#8220;I was blocked by police, then I was pulled away by the demonstrators. I wasn&#8217;t able to get in and convey my wishes,&#8221; Gobai said.</p>
<p>A Regional Representatives Council (DPD) member from Papua, Herlina Murib, was also barred from entering the office.</p>
<p>&#8220;We hope that the police will not repeat this inhuman attitude which was shown by blocking us and removing people who wanted to convey their aspirations. This violates the law&#8221;, Murib said.</p>
<p><strong>Second demonstration</strong><br />
The demonstration at the prosecutor&#8217;s office on Monday was the second one held by activists demanding that Yeimo be allowed to receive hospital treatment.</p>
<p>Protesters had also gathered at the prosecutor&#8217;s office on Saturday, August 28, because the prosecutor was seen as ignoring the court&#8217;s ruling that Yeimo receive treatment.</p>
<p>Because the prosecutor&#8217;s office was empty on Saturday, the <a href="https://asiapacificreport.nz/2021/08/30/protest-call-at-prosecutors-home-to-demand-hospital-care-for-yeimo/">protesters went to the prosecutor&#8217;s private residence</a> where they again called on Kondomo to immediately postpone Yeimo&#8217;s detention.</p>
<p>However, Kondomo refused the request, saying Yeimo could only be released on Tuesday, August 31.</p>
<p>About 3.20pm on Monday, Yeimo was finally allowed to leave the Papua regional Mobile Brigade command headquarters detention centre and was taken to Jayapura public hospital. The ambulance transporting Yeimo was escorted by two police patrol cars and three black minivans.</p>
<p>Around 20 police officers escorted Yeimo to the hospital. Public prosecutors Adrianus Tomana and Valerianus Dedi Sawaki were also present at the hospital.</p>
<p><strong>Advocate and lawyers</strong><br />
Yeimo was accompanied to the hospital by advocate Emanuel Gobay and a number of other lawyers, Laurenzus Kadepa and John NR Gobai along with Yeimo&#8217;s wife and mother.</p>
<p>Speaking to <em>Tabloid JUBI</em> at Jayapura hospital, Tomana said the medical examination was in accordance with the court&#8217;s ruling. Tomana stated that how long Yeimo&#8217;s detention will be deferred would depend on the examination and the doctor&#8217;s diagnosis.</p>
<p>&#8220;How long the deferment will be depends on the results of the doctor&#8217;s examination. If the doctor declares that he is well, then we will revoke the deferment, and Yeimo will be returned to his detention cell,&#8221; he said.</p>

<p>West Papua National Committee (KNPB) diplomacy commission head Kobabe Wanimbo has appealed to the Papuan people to picket the private residence of the chief public prosecutor in the controversial treason trial of an activist who is seriously ill.</p>
<p>The appeal was made to support a demand that KNPB international spokesperson Victor Yeimo be transferred from the Mobile Brigade command headquarters (Mako Brimob) detention centre to a hospital because his health has further deteriorated.</p>
<p>Yeimo was arrested by security forces because of his alleged link to riots in Papua in 2019.</p>

<p>Since he has been detained, however, his state of health has become critical.</p>
<p>&#8220;[His illness] is because of a consequence of his lungs and a chronic [ailment]. Moreover, the doctor has advised that Victor Yeimo must be treated in hospital,&#8221; said Wanimbo in a media release received by Suara.com at the weekend.</p>
<p>Although his state of health has worsened, the prosecutor handling his case is said not to care.</p>
<p>Yeimo was forcibly taken back to the Papua regional police Mako Brimob detention centre after earlier being treated at the Jayapura public hospital in defiance of a court ruling.</p>
<p><strong>Hospital treatment ruling</strong><br />
The court ruling on August 26 in Yeimo&#8217;s case instructed the prosecutor to postpone Yeimo&#8217;s detention and prosecution so that he could be treated at a public hospital in Jayapura.</p>
<p>Moreover, the chief public prosecutor was also ordered to place Yeimo in detention only after his health had improved.</p>
<p>KNPB members and other activists went to the chief public prosecutor&#8217;s private residence in the Doc 2 area of Jayapura city to demand that permission be immediately granted for Yeimo to receive medical treatment.</p>
<p>The KNPB also appealed to all Papuan people to gather at the prosecutor&#8217;s residence to support the demand.</p>

<p>The panel of judges hearing the case against a West Papuan activist accused of treason have ordered the prosecution to prioritise the defendant&#8217;s health, <a href="https://suarapapua.com/2021/08/27/victor-yeimo-dipaksa-untuk-tidak-dirawat-di-rumah-sakit/">reports <em>Suara Papua</em></a>.</p>
<p>At the second hearing on Thursday when the charges were supposed to be read out against West Papua National Committee (KNPB) international spokesperson Victor Yeimo, the judges ordered the prosecution to take him to a hospital for intensive treatment because of his deteriorating health.</p>
<p>The first and second court hearings this week were postponed because of Yeimo&#8217;s worrying state of health and because he was unable to attend the hearing.</p>

<p>On Friday, Yeimo was taken to the Jayapura public hospital in Dok II for an examination and treatment.</p>
<p>John NR Gobay and Laurenzus Kadepan &#8212; two members of the Papua Regional House of Representatives (DPRD) &#8212; have declared that they are ready to stand as guarantors for Yeimo while he is being treated.</p>
<p>Papua Legal Aid Foundation (LBH) director Emanuel Gobay has also declared that he is ready to become a guarantor.</p>
<p>This was conveyed to the panel of judges at the Jayapura District Court on Thursday who subsequently granted the request.</p>
<p><strong>Pressure from prosecutor</strong><br />
When contacted by <em>Suara Papua</em> on Friday, Gustaf Kawer, one of the members of Yeimo&#8217;s team of defence lawyers, revealed that after Yeimo had been taken to hospital there was pressure from the prosecutor who said Yeimo was not allowed to receive inpatient care.</p>
<p>&#8220;It is correct that Victor was taken to hospital earlier. But on the matter of inpatient care this is still being debated with the prosecutor because he doesn&#8217;t want Victor Yeimo to be treated at the Doc II hospital,&#8221; he told <em>Suara Papua</em>.</p>
<p>According to Kawer, there was a debate between Yeimo&#8217;s lawyers and the prosecutor at the hospital.</p>
<p>Yeimo and his lawyers wanted him to be treated at the hospital while the prosecutor did not.</p>
<p>Kawer said that the administrative requirements could be completed and would be handed over on Monday.</p>
<p>&#8220;What we are asking and urging is that Victor Yeimo&#8217;s health [be prioritised]. His state of health is not good,&#8221; Kawer aid.</p>
<p><strong>&#8216;He must be treated in hospital&#8217;</strong><br />
&#8220;He must be treated in a hospital. We already have the guarantors. The administrative requirements can be handed over on Monday. What we want is for Victor to be treated. Victor&#8217;s health is most important.&#8221;</p>
<p>A video received by <em>Suara Papua</em> on Friday evening shows Yeimo at the Dok II Jayapura hospital emergency unit. Several photographs received also show Yeimo being examined by a team of medics at the hospital.</p>
<p>Meanwhile, another video received by <em>Suara Papua</em> shows Yeimo debating with the authorities and the prosecutor who are insisting that Yeimo not be treated at the hospital.</p>

<p>A pro-independence activist in Indonesia’s Papua province will stand trial next week on charges of treason, says his lawyer.</p>
<p>A day earlier, one protester suffered gunshot wounds when police opened fire to disperse a rally demanding the activist Victor Yeimo’s release, activists and a church group said.</p>
<p>Yeimo’s attorney, Gustav Kawer, said his client’s arraignment was scheduled for Tuesday, August 24, and expressed concern about his deteriorating health.</p>

<p>“Despite his health condition, he is still forced to go on trial. This is an attempt to pursue a timetable regardless of the quality of the trial,” Kawer told <a href="https://www.benarnews.org/english/news/">BenarNews</a>.</p>
<p>Yeimo, the international spokesman for the West Papua National Committee (KNPB), a group seeking a referendum on independence for the region, was arrested in May for allegedly leading anti-Jakarta demonstrations that turned into deadly riots there in 2019.</p>
<p>Yeimo is facing charges of treason, desecration of state symbols, and weapons smuggling, police said. He could face two years to a maximum of life in prison, if found guilty.</p>
<p>In 2019, more than 40 people were killed in Papua during demonstrations and riots sparked by the harsh and racist treatment of Papuan students by government security personnel in Java that August.</p>
<p>The incident cast another spotlight on longtime allegations of Indonesian government forces engaging in racist actions against indigenous people in mainly Melanesian Papua, where violence linked to a pro-independence insurgency has simmered for decades, and grown in recent months.</p>
<p>Last year, at least 13 Papuan activists and students were convicted for raising <em>Morning Star</em> flags &#8212; the symbol of the Papuan independence movement &#8212; during pro-referendum rallies in 2019 as part of nationwide protests against racism towards Papuans.</p>
<p>They were sentenced to between nine and 11 months in prison on treason charges.</p>

<p><strong>Team of doctors &#8216;not independent’<br />
</strong>Yeimo’s lawyer, Kawer, said that repeated requests from the legal team for his client to undergo a comprehensive health check-up were denied, although he had complained of chest pain and coughed up blood.</p>
<p>Yeimo is being detained at a facility run by the Mobile Brigade police unit, Kawer said. The activist is lodged in a cell with minimal lighting, poor air circulation, and located next to a septic tank, he added.</p>
<p>Kawer said he had sent a letter to the prosecutor’s office requesting that Yeimo be transferred to the main Abepura prison in Jayapura but there had been no response.</p>
<p>Kawer acknowledged that his client had previously undergone two health examinations since his detention &#8212; the last one on June 17 &#8212; but they had not been thorough.</p>
<p>“We suspect that the team of doctors is not independent. We are very worried that the results will be brought to court, but they are not in accordance with Yeimo’s actual condition,” Kawer said.</p>
<p>Police spokesman Ahmad Musthofa Kamal denied that Yeimo was ailing.</p>
<p>“He is fine. He has been examined by hospital doctors, not from the police, and is accompanied by a lawyer,” Kamal said.</p>
<p><strong>Bail to be requested</strong><br />
The head of the Papuan branch of the National Commission on Human Rights (Komnas HAM), Frits Ramandey, said he would request bail for Yeimo.</p>
<p>Yeimo’s arrest was not his first brush with the law.</p>
<p>In 2009, he was arrested and sentenced to a year in prison for leading a rally demanding a referendum on self-determination for Papua.</p>
<p>In 1963, Indonesian forces invaded Papua and annexed the region, which makes up the western half of New Guinea Island. Papua was formally incorporated into Indonesia after a disputed UN-sponsored ballot called the &#8220;Act of Free Choice&#8221; in 1969.</p>
<p>Locals and activists said the vote was a sham because only about 1000 people took part. However, the United Nations accepted the result, which essentially endorsed Jakarta’s rule.</p>
<p>The region is rich in natural resources but remains among Indonesia’s poorest and underdeveloped ones.</p>
<p><strong>‘They beat us with rifle butts’<br />
</strong>On Monday, a 29-year-old protester, Ferianus Asso, suffered a gunshot wound to his stomach after police opened fire to disperse the crowd during a rally demanding Yeimo’s release in Yahukimo regency on Monday.</p>
<p>“Ferianus is still undergoing treatment at a hospital in Yahukimo,” said Jefry Wenda, spokesman for the Papuan People’s Petition.</p>
<p>Wenda said police detained at least 48 protesters in Yahukimo but all but four had been released.</p>
<p>Papuan police spokesman Kamal said all detainees had been released.</p>
<p>“We are not detaining any protester at the moment,” Kamal said.</p>
<p>In the provincial capital Jayapura, KNPB chairman and former political prisoner Agus Kossay suffered a head injury after he was hit by a police gunstock &#8212; a support to which the barrel of a gun is attached.</p>
<p>“They sprayed us with water and beat us with rifle butts until we bled, but even if they beat and kill us, we will still fight racism, colonialism and capitalism,” Kossay said in a video clip sent to <em>BenarNews</em>.</p>
<p><strong>&#8216;Violating&#8217; covid-19 rules</strong><br />
Jayapura police chief Gustav R. Urbinas said the mass dispersal was carried out because the demonstration did not have an official permit and violated covid-19 social distancing rules.</p>
<p>Urbinas said that the crowd attacked the police who tried to disband the protest.</p>
<p>“Our personnel had to take firm action to prevent them from causing public disturbances,” he said in a statement.</p>
<p>Kossay, however, said the organisers had notified the police about the protest three days earlier.</p>
<p><a href="https://asiapacificreport.nz/2021/08/17/open-letter-from-papua-indonesian-state-creates-stalemate-of-injustice/">Reverend Socratez S. Yoman</a>, president of the Fellowship of Baptist Churches of West Papua, condemned the use of violence by police against the protesters.</p>

<p>Yeimo, the foreign spokesman for the West Papua National Committee (KNPB), was arrested in May and faces numerous charges, including treason and incitement, for his alleged role in anti-racism protests in 2019.</p>
<p>Demonstrations have been taking place today in cities and towns across the Papuan provinces including Jayapura, Wamena, Manokwari and Timika.</p>
<p>In Jayapura, police forces backed up by water canons dispersed demonstrators at numerous locations. Several Papuans were injured, including the KNPB&#8217;s chairman Agus Kossay.</p>

<p>One demonstrator was shot at a rally in Dekai, Yahukimo, a remote highlands regency, while eight people were reportedly arrested.</p>
<p>Even a vigil march this morning in Jayapura led by the West Papua Council of Churches&#8217; moderator Rev Benny Giay was stopped by security forces.</p>
<p>As with their crackdown on <a href="https://www.rnz.co.nz/international/pacific-news/446968/indonesian-police-crack-down-on-west-papuan-demos">Papuan demonstrations last month</a> and <a href="https://www.rnz.co.nz/international/pacific-news/443349/indonesian-police-crack-down-on-west-papuan-protests">in May</a>, police have said that due to the covid-19 outbreak in Papua, they would not allow public events such as demonstrations to proceed.</p>
<p>The Papuan People&#8217;s Petition is reportedly supported by more than 700,000 people who have signed the petition rejecting Special Autonomy, and demanding the immediate release of Victor Yeimo without any conditions.</p>
<p>&#8220;Victor Yeimo is not a perpetrator of violence or a criminal. He is the victim of widespread structural racism of the Indonesian colonial state who continues to persecute Indigenous Papuans,&#8221; said PRP National Spokesperson Sam Awom.</p>
<p>Human rights advocates, including the UN Special Rapporteur on human rights defenders Mary Lawlor have <a href="https://asiapacificreport.nz/2021/08/12/international-calls-grow-to-free-papuan-activist-victor-yeimos-over-health/">voiced concern at Yeimo&#8217;s reportedly deteriorating health</a> in prison.</p>

<p>International pressure is mounting on Indonesia to free West Papuan activist Victor Yeimo, the international spokesperson for the peaceful civilian West Papua National Committee (KNPB), as concern grows over his worsening state of health.</p>
<p>Following the UN Special Rapporteur on Human Rights Defenders Mary Lawlor&#8217;s declaration on twitter two days ago that Yeimo was at risk of being infected with covid-19, the Australia West Papua Association (AWPA) has written to Foreign Minister Marise Payne saying there was concern over his deteriorating health.</p>
<p>&#8220;He is losing weight and has been coughing blood for the past few days,&#8221; spokesman Joe Collins said in the letter today.</p>

<p>Amnesty International Indonesia has also raised concerns about Yeimo and about the arrest of <a href="https://en.tempo.co/read/1493107/amnesty-international-indonesia-condemns-arrest-of-14-papua-university-students">14 Cendrawasih University (Unicen) students</a> who on Tuesday called for his release from Mako Brimob prison in the Papuan capital Jayapura.</p>
<p><a href="https://www.indoleft.org/news/2021-08-09/knpb-renews-call-to-release-victor-yeimo-as-papuan-activists-health-deteriorates.html"><em>Suara Papua</em> reports</a> that the KNPB on Monday urged the Papua regional police and the Papua chief public prosecutor to immediately release Yeimo because there was no legal basis for his detention and his health had been deteriorating since his arrest on May 9.</p>
<p>&#8220;For the sake of humanity and the authority of the Indonesian state, immediately release Victor Yeimo and all Papuan independence activists who have been arrested without [legal] grounds, evidence or witnesses,&#8221; said KNPB chairperson Agus Kossay in a media statement.</p>
<p>&#8220;The Papuan people are not the perpetrators of racism.&#8221;</p>
<p><strong>&#8216;Disturbing reports&#8217;</strong><br />
Lawlor&#8217;s twitter post the following day said: &#8220;I am hearing disturbing reports that human rights defender from #WestPapua, Victor Yeimo, is suffering from deteriorating health in prison. I&#8217;m concerned because his pre-existing health conditions put him at grave risk of #COVID-19.&#8221;</p>

<p>Yeimo faces a number of charges, including treason, because of his peaceful role in the anti-racism protests on 19 August 2019.</p>
<p>He is accused of violating Articles 106 and 110 of the Criminal Code on treason and conspiracy to commit treason.</p>
<p>Many analysts on West Papuan affairs consider these charges to be trumped up.</p>
<p>Amnesty International Indonesia deputy director Wirya Adiwena said that the students protesting for Yeimo should be protected — not arrested and treated like criminals.</p>
<p>&#8220;Like Victor, these Uncen students are only using their right to exercise freedom of expression, assembly and association, to peacefully speak their minds,&#8221; said Adiwena.</p>
<p><strong>Against human rights</strong><br />
The jailing of peaceful activists because they had taken part in a demonstration was against their rights under the Universal Declaration of Human Rights which states,<br />
Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek receive and impart information and ideas though any media and regardless of frontiers (Article 19).</p>
<p>Article 20(1) states that everyone has the right to freedom of peaceful assembly and association.</p>
<p>Lawyer and human rights activist Veronica Koman also called for the release of Yeimo.</p>
<p>“Victor Yeimo will not be safe if he remains behind [the bars] of a colonial prison. Colonialism will continue to demand political sacrifices,” <a href="https://asiapacificreport.nz/2021/08/11/lawyer-veronica-koman-joins-calls-to-free-papuan-activist-victor-yeimo/">wrote Koman on her Facebook</a>.</p>
<p>Collins of AWPA said his movement was greatly concerned that by denying Yeimo proper adequate medical care, the Indonesian authorities were putting his him at &#8220;grave risk of death or other irreversible damage to his health&#8221;.</p>
<p>The AWPA called on Minister Payne &#8220;to use your good offices with the Indonesian government to call for the immediate and unconditional release of Victor Yeimo and all political prisoners&#8221;.</p>

<p>Lawyer and human rights activist Veronica Koman has spoken out about the worsening health of Papuan activist <a href="https://asiapacificreport.nz/?s=Victor+Yeimo">Victor Yeimo</a> who has been detained at the Mobile Brigade command headquarters detention centre (Rutan Mako Brimob) for the last three months, reports <a href="https://suarapapua.com/2021/08/09/ini-pendapat-veronica-koman-terhadap-kondisi-victor-yeimo/"><em>Suara Papua</em></a>.</p>
<p>&#8220;Victor Yeimo will not be safe if he remains behind [the bars] of a colonial prison. Colonialism will continue to demand political sacrifices,&#8221; wrote Koman on her Facebook on Monday.</p>
<p>Koman said that Yeimo&#8217;s imprisonment is part of the colonisation of the Papuan people&#8217;s dignity which had been going on for decades.</p>

<p>&#8220;The imprisonment of Victor is a problem of trampling on the West Papuan people&#8217;s dignity: The West Papuan people aren&#8217;t allowed to fight racism, the West Papuan people aren&#8217;t allowed to speak about self-determination &#8212; even in a peaceful manner,&#8221; she wrote.</p>
<p>Koman believes that moving Yeimo, who is in a weak condition, to Abepura prison is the same as moving him from one &#8220;tiger&#8217;s den&#8221; to another.</p>
<p>&#8220;The Abepura prison is over-capacity, so it&#8217;s a nest of covid-19. Because of this, [we must] unite in the demand: Release Victor Yeimo right now!&#8221; said Koman.</p>
<p>Yeimo, who is the West Papua National Committee (KNPB) international spokesperson and spokesperson for the Papua People&#8217;s Petition (PRP), was arrested by police in the Tanah Hitam area of Abepura in Jayapura city on May 9.</p>
<p>He was detained at the Papua regional police headquarters before being transferred to the Brimob detention centre.</p>
<p>Since his arrest there have been ongoing calls for his release from the charges against him. The charges and lack of access to lawyers and family are considered not to be in accordance with the law.</p>

<p>Because of this, the government of President Joko &#8220;Jokowi&#8221; Widodo is being urged to immediately release Yeimo along with all Papuan students and people from prisons in Indonesia.</p>
<p>&#8220;Victor Yeimo is not the perpetrator of racism. He is in fact a victim of racism. He was not involved in the [August-September 2019] riots in Jayapura city.</p>
<p>&#8220;Why after three months is he still being held at the Papua Brimob? His health is deteriorating. We are asking that he be released immediately from prison,&#8221; said Sam Gobay, who is on the management board of the Mee ethnic group traditional council in Mimika regency.</p>
<p>From information received by Gobay, Yeimo&#8217;s health had deteriorated drastically.</p>
<p>&#8220;There is no access to healthcare for Victor Yeimo. He&#8217;s ill, he&#8217;s not being allowed treatment. He also isn&#8217;t being given food. All access is restricted.</p>
<p>&#8220;What is the plan for Victor Yeimo? We&#8217;re asking for Victor&#8217;s immediate release&#8221;, he said.</p>
<p>The arrest of detention of Yeimo is seen as part of curbing democratic space and even an effort to criminalise Papuan activists.</p>
<p>&#8220;What kind of legal basis is there for the state to discriminate against Victor Yeimo. He is not a perpetrator of racism, let alone labeling him as committing <em>makar</em> [treason, rebellion, sedition].</p>
<p>&#8220;Everyone knows that Victor Yeimo was not involved in the demonstrations which ended in riots in Jayapura city,&#8221; said Gobay.</p>
<p>&#8220;The Papuan people are urging Bapak [Mr] Jokowi to immediately urge the Indonesian police chief and the Papuan regional police chief to release Victor Yeimo from the Brimob detention centre,&#8221; said Gobay.</p>
<p>A similar statement was made by KNPB general chairperson Agus Kossay in a press release on Monday.</p>
<p>The KNPB is urging the Papuan regional police and the Papua chief public prosecutor to immediately release Yeimo. According to Kossay, Yeimo had been detained without legal basis and his health continued to deteriorate.</p>
<p>&#8220;For the sake of humanity and the authority of the Indonesian state, immediately release Victor Yeimo and all Papuan independence activists who have been arrested without [legal] grounds, evidence or witnesses. The Papuan people are not the perpetrators of racism,&#8221; said Kossay.</p>
<p>KNPB spokesperson Ones Suhuniap, meanwhile, said that if Yeimo was not released then the KNPB would call on all Papuan people and all KNPB activists to get themselves arrested by police.</p>
<p>He also believes that the Papua regional police and the prosecutor&#8217;s office have violated Indonesian law.</p>
<p>&#8220;Victor Yeimo must be released for the sake of the law because based on the KUHP [Criminal Code] the 60 day period of detention has already passed, but the addition of 30 more days detention for Victor Yeimo violates the law itself,&#8221; said Suhuniap.</p>
<p>Earlier, Yeimo&#8217;s lawyer Emanuel Gobay, who is from the Papua Law Enforcement and Human Rights Coalition (KPHHP), urged the Papuan and Jayapura chief prosecutors to respond to their call to transfer Yeimo from the Brimob detention centre to Abepura prison.</p>
<p>This call, according to Gobay, is based on the fact that Yeimo had been incarcerated at the Brimob detention centre since May 10 and his rights as a suspect had not been met.</p>
<p>&#8220;When the prosecutor questioned Victor Yeimo in relation to matters that he wished to convey, Victor asked to be transferred from the Rutan Mako Brimob to the Abepura prison in consideration of meeting his rights as a suspect.</p>
<p>&#8220;Victor argued that since the start of his detention at the Papua regional police Mako Brimob he has been neglected because of the Mako Brimob&#8217;s standard operating procedures. Also because of his psychological condition as a result of being left alone in a stuffy cell which could endanger his health,&#8221; explained Gobay.</p>
<p>Unfortunately, said the director of the Papua Legal Aid Foundation (LBH), the prosecutor failed to respond professionally to Yeimo&#8217;s request.</p>
<p>&#8220;The Papua chief public prosecutor [must] immediately instruct the Papua chief public prosecutor supervising prosecutor acting as the Jayapura chief public prosecutor supervising prosecutor to examine the prosecutor who received the dossier of the suspect in the name of Victor F Yeimo which was not conducted in accordance with the instructions of Article 8 Paragraph (3) b of Law Number 8/1981,&#8221; he said.</p>
<p>Also, the head of the Papua representative office of the Ombudsman of the Republic of Indonesia has been asked to supervise the Jayapura district attorney&#8217;s office in its implementation of Yeimo&#8217;s rights as a suspect which is guaranteed under Law Number 8/1981.</p>
<p>This call was made after the Papua regional police investigators handed Yeimo&#8217;s dossier over to the Jayapura district attorney&#8217;s office on August 6.</p>

<p>Indonesian Mobile Brigade (Brimob) paramilitary police, national police intelligence officers (intel) and the army&#8217;s special forces (Kopassus) have stormed the West Papua National Committee (KNPB) offices in the Almasuh area of Merauke regency, Papua,</p>
<p>The raid last week was reported by a <em>Suara Papua</em> informant from Merauke on Monday. The raid ended with two motorcycles being seized and six more people arrested.</p>
<p>&#8220;Yesterday, on Sunday (13/12/2020) at around 2 pm local time Brimob and intel officers arrived and vandalised the KNPB secretariat in Almasuh, they arrested six people and two motorcycles were taken,&#8221; the source told <em>Suara Papua</em> from Merauke.</p>

<p>When sought for confirmation on Tuesday, Merauke KNPB member Yoris Wopay said that arrests were made on two occasions totalling 14 people who were being held temporarily by the Merauke district police (Polres).</p>
<p>&#8220;They were all arrested and beaten with cane sticks, four people were ordered to lie on the ground, then they were taken to Polres, there they were assaulted again, Kristian Yandun&#8217;s head was cut and bleeding and Michael Beteop&#8217;s back was bleeding, then they were detained with criminal prisoners. And two motorcycles were taken by the Merauke Polres&#8221;, he said.</p>
<p>No reason was given for their detention and the detainees have asked for a lawyer.</p>
<p><em>Suara Papua</em> meanwhile has been unable to obtain confirmation from the Merauke district police about why they were arrested.</p>

<p>The crowd, many of whom wearing headbands of the Morning Star flag &#8211; banned by Indonesian authorities, was blocked from marching to the city center by scores of counterprotesters from several youth organisations waving the Indonesian flag.</p>

<p>They confronted the pro-independence protesters with sharpened bamboos.</p>
<p>Several hundred members of anti-riot police prevented the two rival groups from clashing.</p>
<p>The protest ended after about two hours.</p>
<p>However, human rights sources reported tonight that Indonesian police and military had  surrounded Papuan student dormitories in Surabaya and arrested 223 people. They were being detained at the Surabaya City sector police station.</p>
<p class="ox-1435893cd3-MsoNormal">The <a href="https://www.freewestpapua.org/2018/12/01/300-arrested/">Free West Papuan Campaign reports</a> that more than 300 people have been arrested across West Papua.</p>
<p class="ox-1435893cd3-MsoNormal"><strong>Peaceful demonstrations</strong><br />
In several regions of West Papua, peaceful demonstrations took place. Protests were reported in Jakarta, Surabaya, Palu, Kupang, Ternate, Makassar, Manado, Ambon, Poso, Sula, Timika, Meruake, Waropen, and Tobelo.</p>
<p class="ox-1435893cd3-MsoNormal">In addition to police intervention during public gatherings, the London-based campaign&#8217;s website said it had received reports that Indonesian security forces had also raided several student dormitories, and the West Papua National Committee (KNPB) headquarters was vandalised.</p>
<p class="ox-1435893cd3-MsoNormal">From the monitoring team, below is the interim report of arrests throughout West Papua and other parts of Indonesia:</p>

9. Sorong and Merauke, including KNPB HQ in Waena, Perumnas III: in lock down and an urgent need for advocacy at these places.</p>

<p class="ox-1435893cd3-MsoNormal">Today marks the 57th anniversary of the first time West Papua’s flag of independence, the <em>Morning Star</em>, was raised.</p>

<p class="ox-1435893cd3-MsoNormal">In commemoration of the historic event numerous non-violent peaceful demonstrations and prayer vigils were organised around the country.</p>
<p class="ox-1435893cd3-MsoNormal">Worldwide flag raisings of international solidarity increase each year as the support for West Papuan independence gains momentum. In New Zealand, flagraising events were held in Auckland, Wellington and Christchurch.</p>
<p class="ox-1435893cd3-MsoNormal">This protests comes at a time of increased violence in West Papua, including suspected extrajudicial killings in the region.</p>
<p class="ox-1435893cd3-MsoNormal">Urgent issues of concern also include increased military presence, the killing of civilians caught in crossfire in the mountain regions, and armed civilian movements of Papuans protecting their villages.</p>
<p class="ox-1435893cd3-MsoNormal">The International Coalition for Papua (ICP) compiles data on political arrests and violence in West Papua. This information has been made public through quarterly reports. <p>The Asian Human Rights Commission (AHRC) has condemned the unlawful deprivation of liberty of Papuans which has has been happening frequently lately.</p>
<p>The AHRC has learned that the Indonesian Security Forces have been using excessive force and flaunting their authority to illegally arrest indigenous Papuans.</p>
<p>They are simply exercising their rights to freedom of expression and opinion and peaceful assembly, the watchdog agency said in a statement.</p>
<p>For instance, take the case which took place on August 20, 2017. Police officers of the Fak-Fak police station (Polres Fak-Fak) arbitrarily arrested 24 indigenous Papuans, said AHRC.</p>
<p>They are members of the National Committee for West Papua (KNPB). The AHRC was informed that they were illegally arrested because they were registered to attend a meeting organised by KNPB in Fak-Fak Regency, West Papua province.</p>
<p>Previously, the AHRC had noted some similar cases faced by members of KNPB Papua.</p>
<p>Yanto Waine, a member of the National Committee for West Papua (KNPB), was illegally detained in the Nabire police station (Polres Nabire) after distributing leaflets to the public.</p>
<p><strong>Students arbitrarily arrested</strong><br />
Twenty nine student activists, mostly Papuan students, were arbitrarily arrested in Yogyakarta province. An additional 32 student activists in Jakarta and 46 student activists in Semarang were also arbitrarily detained.</p>
<p>Considering the massive unlawful deprivation of liberty against indigenous Papuans, the AHRC said it strongly recommended that the government &#8220;re-evaluate its policy and the behaviour of its Security Forces&#8221;.</p>
<p>The government should ensure that there was no policy in practice that clearly violated or went against the International Covenant on Civil and Political Rights (ICCPR). Indonesia became a state party to this covenant by enacting Law No.12 of 2005.</p>
<p>Article 19 of the ICCPR states:</p>
<p><em>1. Everyone shall have the right to hold opinions without interference.</em></p>
<p><em>2. Everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of choice.</em></p>
<p><em>3. The exercise of the rights provided for in paragraph 2 of this Article carries with it special duties and responsibilities. It may therefore be subject to certain restrictions, but these shall only be such as are provided by law and are necessary:</em></p>
<p><em>(a) For respect of the rights or reputations of others;</em></p>
<p><em>(b) For the protection of national security, public order, and public health or morals.</em></p>
<p><strong>Freedom of assembly</strong><br />
Moreover, the Indonesian Constitution 1945 (UUD 1945) clearly guarantees such rights.</p>
<p>Article 28 of the Constitution states: <em>&#8220;the freedom to associate and to assemble, to express written and oral opinions, etc., shall be regulated by law.&#8221;</em> Further, Article 28 paragraph E states: &#8220;<em>Every person shall have the right to the freedom to associate, to assemble and to express opinions.&#8221;</em></p>
<p>Under the Constitution, Indonesia, Law No. 39 of 1999 on Human Rights. Article 24 paragraph 1 states: <em>&#8220;Everyone has the right to peaceful assembly and association.&#8221;</em> Article 6 paragraph 1, relating to indigenous People states: <em>&#8220;In the interests of upholding human rights, the differences and needs of Indigenous Peoples must be taken into consideration and protected by the Law, the Public and the Government.&#8221;</em></p>
<p>&#8220;Let us look into the cases of human rights violations, in particular massive unlawful deprivation of liberty in Papua. It has been proven that the government has failed to ensure that the Security Forces obey and respect the above-mentioned rights,&#8221; the AHRC statement said.</p>
<p>&#8220;Even security forces violate the Indonesian Criminal Procedure (KUHAP), which regulates steps and requirements of arrest and detention.</p>
<p>&#8220;The government should be aware that extreme restrictions against the right to freedom of opinion, expression and also peaceful assembly, should be conducted based on the Law. It is the National Law which regulates such restrictions and they should not violate or go against the ICCPR itself.&#8221;</p>
<p>The AHRC said as outlined in General Comments of the ICCPR No. 35 paragraph 12 <em>&#8220;An arrest or detention may be authorised by domestic law and nonetheless be arbitrary. The notion of &#8216;arbitrariness&#8217; is not to be equated with &#8216;against the law&#8217;. It must be interpreted more broadly to include elements of inappropriateness, injustice, lack of predictability and due process of law, as well as elements of reasonableness, necessity and proportionality.&#8221;</em></p>
<p><strong>&#8216;End stigmatisation&#8217;</strong><br />
The AHRC called for the Indonesian government to stop any patterns and forms of unlawful deprivation of liberty against indigenous Papuans.</p>
<p>&#8220;The right to freedom of expression, opinion and peaceful assembly must be protected and respected,&#8221; the AHRC statement said.</p>
<p>&#8220;Furthermore, the Indonesian Security Forces should not subjectively interpret the Law and put an end to the stigmatisation that all political activities conducted by Papuans are crimes. The AHRC urges the government to release all those persons arrested with no criminal charges laid against them.&#8221;</p>

										<content:encoded><![CDATA[<p>Yanto Awerkion, a West Papuan local independence leader, remains imprisoned after being arrested the Indonesian security services for collecting signatures on an <a href="https://secure.avaaz.org/en/petition/SecretaryGeneral_of_the_United_Nations_Antonio_Guterres_End_the_Genocide_in_West_Papua/?pv=36">Avaaz petition</a> calling for a new referendum on independence from Indonesia.</p>
<p>Awerkion, deputy chairperson of the Timika branch of the pro- independence West Papua National Committee (KNPB), <a href="https://www.freewestpapua.org/2017/06/23/west-papuan-leader-arrested-and-office-raided-for-supporting-petition/">remains behind bars since his arrest</a> on June 23.</p>
<p>Minutes after Awerkion took to the stage at a rally supporting the global petition, Indonesian security services surrounded the gathering and arrested Awerkion.</p>

<p>The arrest forms part of a growing Indonesian strategy to arrest and imprison any Papuan who voices support for independence or self-determination in the territory.</p>
<p>Between June 30 and July 6, <a href="https://asiapacificreport.nz/2017/07/10/150-reported-arrested-in-new-west-papua-crackdown-on-activists/">about 150 Papuans were arrested</a> – many of them beaten and tortured – for non-violent acts of resistance to Indonesian rule.</p>
<p>The International Coalition for Papua documented <a href="http://www.humanrightspapua.org/hrreport/qarterly-reports/2nd-qarter-2017">321 political arrests of West Papuans</a> in the second quarter of 2017.</p>
<p>West Papuans have been fighting for independence against Indonesia since 1963, in what has become one of the world’s longest-running military occupations.</p>
<p><strong>Regular reports of torture</strong><br />
Hundreds of thousands of West Papuans have <a href="http://www.aljazeera.com/indepth/opinion/2012/03/201232172539145809.html.">lost their lives in the occupation</a>, and reports of Papuans being shot, imprisoned, kidnapped and torture regularly filter out of the provinces.</p>
<p>Global attention on West Papua has been steadily growing in recent years with the unification of the Papuan representative bodies under the <a href="https://www.ulmwp.org/">United Liberation Movement for West Papua</a>,  the formation of the Pacific Coalition for West Papua and the launching of a petition to the UN calling on the international community to support a new referendum in West Papua.</p>
<p>The petition has already gained 33,000 signatures across the globe, with tens of thousands of signatures being collected by hand in West Papua itself.</p>
<p>Awerkion was arrested at one of the mass manual signings of the petition in Timika, West Papua.</p>
<p>At the end of August this year, the petition will be <a href="http://www.swimforwestpapua.com">swum almost 70km for 30 hours</a> up Lake Geneva to the UN offices by a British swim team.</p>
<p>Speaking before his arrest, Awerkion said: “I thank people all over the world for standing up for political prisoners in West Papua.”</p>
<p>British-based Benny Wenda said of the gathering where Awerkion was arrested: “I am proud that the people of West Papua remained calm and peaceful, singing hymns as their gathering was raided by the Indonesian military and police.</p>
<p>&#8220;We are showing the Indonesian government that we will not be provoked by their terror and brutality. Like Mahatma Gandhi, we will fight successfully for our freedom through peace and love.”</p>

<p>Thousands marched across the region to support West Papuan freedom and to condemn decades of brutal treatment of indigenous Melanesians by Indonesia, reports <a href="http://www.telesurtv.net/english/news/More-Than-500-Arrested-in-West-Papuan-Independence-Protests--20161220-0008.html">TeleSur</a>.</p>
<p>A total of 528 people, including several children were arrested in the peaceful rallies across Indonesia’s most eastern province of Papua. A number had already been detained the night before the planned protests and activists reported that a number of people were beaten and badly injured before being arrested.</p>
<p>Activists also said that several who were detained were interrogated without a lawyer and at least one protester was tortured by Indonesian police.</p>
<p>Journalists were banned from several areas and the headquarters of the West Papua National Committee in Jayapura was vandalised.</p>
<p><strong>15 locations</strong><br />
Demonstrations took place in at least 15 locations and several people were arrested after applying for demonstration permits with authorities, according to civil rights lawyer Veronica Koman, who is representing independence activist Filep Karma.</p>
<p>Karma has been detained since 2004 for peacefully protesting for his people’s independence.</p>
<p>“This year alone over 4800 people have been unlawfully arrested and many others killed and tortured by the Indonesian military and police,” said exiled West Papua independence leader <a href="http://www.telesurtv.net/english/opinion/West-Papuas-Forgotten-Struggle-for-Independence-20160915-0018.html">Benny Wenda</a> in a statement.</p>
<p>Monday’s protests coincided with the anniversary of “Operation TRIKORA,” which was carried out when the Indonesian government invaded West Papua on December 19, 1961, after Melanesian West Papuans first raised their <em>Morning Star</em> flag on December 1.</p>
<p>The region was then annexed by Indonesia in 1969 in a controversial referendum after winning independence from Dutch colonialism in 1963. Independence supporters say that the 1969 annexation is illegal and that Indonesian control has amounted to genocide.<br />

<p>Throughout Indonesia&#8217;s hard rule of the mineral-rich area, around half a million Melanesian West Papuans are thought to have been killed by Indonesian authorities and pro-independence supporters face restrictions of movement and assembly, media blackouts, and many also have been held as political prisoners.</p>
<p>Protesters were also throwing their support behind the full membership of the United Liberation Movement for West Papua, ULMWP, to the Melanesian Spearhead Group, MSG. The group includes other Melanesian nations, Vanuatu, Fiji, Papua New Guinea and the Solomon Islands.</p>
<p>A meeting is due to be held this month in Vanuatu to discuss membership, which would give West Papua an international platform to push for independence.</p>
<p>A number of nations from the MSG have <a href="http://www.telesurtv.net/english/news/Pacific-Nations-Condemn-Indonesian-Abuses-in-West-Papua-20160927-0019.html">already publicly backed </a>West Papua’s struggle for self-determination and condemned Indonesian human rights abuses in the area.</p>

<p>The men whose faces were covered in scarves banged on the windows and doors of Aud’s home and shouted orders for him to come out.</p>
<p>When the men had smashed his window, Aud saw that two of the men were armed with rifles and refused to come out.</p>
<p>He managed to make a phone call to his friends asking them to immediately come to his house.</p>
<p>Aud thought he would be abducted and later killed by the men, as happened to <a href="https://www.freewestpapua.org/2014/09/01/benny-wendas-statement-on-murder-of-papuan-leader-martinus-yohame/">Martinus Yohame</a>, another KNPB Sorong member, in August 2014.</p>
<p>At 4am, six of Aud’s friends arrived at his house and saw that there were at least 10 men with guns and rifles with a minibus and three motorcycles. As soon as they arrived, the men left.</p>
<p>In the last few months, Aud had organised many press conferences and peaceful demonstrations to support the <a href="https://www.ulmwp.org/">United Liberation Movement for West Papua</a> (ULMWP) to be accepted as a full member of Melanesian Spearhead Group (MSG)</p>
<p>Amnesty International has stated the attempt to abduct Aud highlights the unsafe environment faced by political activists in the Indonesian province of Papua and the ongoing impunity for human rights violations by security forces.</p>
<p>The NGO has launched an urgent <a href="https://www.amnesty.org/en/documents/asa21/4893/2016/en/">appeal</a> for action to ensure Agustinus Aud’s safety.</p>

<p>A number of recent developments in Papua, Indonesia and in the Pacific, have led me to a profound realisation that over the past five decades, we, Papuan people, have not moved from our position in relations with Indonesia.</p>
<p>Our journey to get out of domination and oppressive violence towards our own future with dignity remains confronted with challenges and constraints, as seen in the events that we are recently witnessing.</p>

<p>First, as a reactionary response to the demands of the people of Papua as well as the decision (and possibly pressure) from the Melanesian Spearhead Group (MSG) to send a fact-finding-mission through the Pacific Islands Forum, the Indonesian government has held two focus group discussions (FGD) at a luxury hotel in Jayapura for the so-called &#8220;settlement of human rights issues&#8221;.</p>
<p>The FGDs were sponsored by Indonesia’s coordinating Minister of Economy, Politics, Law and Human Rights Luhut Binsar Pandjaitan, who once made a humiliating remark to the Papuans by saying: &#8220;Just go to Melanesia. No need to stay in Indonesia anymore.&#8221;</p>
<p>The statement by a former Kopassus (Indonesian special forces) general was aimed at the United Liberation Movement for West Papua (ULMWP), an organisation that represents our struggle and aspiration.</p>
<p>His tone reminds us of the statement of General Ali Murtopo in 1969: &#8220;If the Papuans want independence, ask Americans to find an island in the moon for them to live there.&#8221;</p>
<p>A second development that coincided with the FGD is a series of peaceful demonstrations held by the Papuans in West Papua and Indonesia to support ULMWP’s bid for a full membership at the MSG.</p>
<p><strong>2000 detained</strong><br />
Around 2000 activists were detained in a peacefull rally facilitated by the National Committee of West Papua (<em>Komite Nasional Papua Barat,</em> KNPB) on 2 May 2016. This wsas the largest arrest in our history and proves that the Indonesian authorities continue using old tactics of repression: arrests, beatings, and terror against the demonstrators.</p>
<p>Thirdly, the Indonesian government is aggressively lobbying countries and political leaders in the Pacific following the increasing concern and solidarity from the Pacific region and support from the MSG for a resolution of West Papua’s problem.</p>

<p>General Pandjaitan has repeatedly claimed that he has secured Fiji and Papua New Guinea&#8217;s support for Indonesia. On the other hand, Pandjaitan contended that foreigners should not interfere in the affairs of human rights in West Papua.</p>
<p>Fourth, without listening to criticism of hazardous development in West Papua, Jakarta, intensifies a development model that puts Papuans simply as objects, without allowing us to become subjects of our own future.</p>
<p>What does all of this mean for Papuan people?</p>
<p>We, the nation of West Papua might be unlucky. The sun has so far stopped shining in the land of our fathers. Since the early 1960s, our land has been made a site of systemic oppression.</p>
<p>But we do not stay silent. We make ourselves subjects of our own history, maintain our dignity and keep fighting. We use a variety of tactics: through a guerrilla struggle (OPM, the Free Papuan Movement), a messianic movement, human rights discourses and NGOs, media, Arnold Ap and his cultural movement, mass urban-based movements such as of KNPB, churches with their critical voices, and so forth.</p>
<p><strong>Many have fled</strong><br />
Apart from the struggles in our own land, some of us have to flee. In the 1960s, a wave of refugees fled to the Netherlands.</p>
<p>Melanesian countries in the Pacific have also became destinations of West Papuan refugees from the 1960s until the 1990s.</p>
<p>Political activists seek political protection in Papua New Guinea, Vanuatu, Australia, Europe, and so forth. In 1969 alone, about 3000 Papuans fled to PNG. Osborne (2001) and Smith (1988) estimate that between 1500-3000 Papuans crossed into PNG and other countries in 1977-1978.</p>
<p>Our history can be written as a history of a fleeing nation. A nation that is oppressed and expelled from our own country, a nation that is walking toward a promised land.</p>
<p>Our journey is stained by stories of those who died and drowned on the way to reach Vanimo, stories of those who walked day and night to reach the land of freedom.</p>
<p>We would like to thank our Melanesian brothers and sisters in the Pacific who are never tired of showing us their unwavering support and solidarity. We thank church leaders, including the Catholic Bishop of Vanimo, Vanuatu, and the Solomon Islands and civil societies in these countries.</p>
<p>The Catholic Bishop of Vanimo granted his land to accommodate members of our congregation because in our own land churches have failed to defend the scattering God’s flocks.</p>
<p><strong>Thanks to Vanuatu, Solomon Islands</strong><br />
We express our thanks to the Vanuatu government that has been trying to unite our leadership from different factions within the struggle. We thank the Prime Minister of the Solomon Islands who offered to mediate an authentic dialogue between ULMWP and the Indonesian government.</p>
<p>We are grateful to the leadership of MSG who has been accepting us in the Melanesian brotherhood.</p>
<p>But we also apologise. We apologise for the inconvenience caused by the presence of our people in the Pacific. We apologise for our helplessness that forced our brothers and sisters in the Pacific to carry our burden and stand in solidarity with us.</p>
<p>We apologise that the burden of our struggle has become a burden of our Melanesian brothers and sisters. We apologise that our struggle changes the political dynamics of Melanesian nations, forcing Melanesian nations to confront each other.</p>
<p>I believe that all of this is not an accident of history. Indeed, West Papua is a product of history that is blind to our suffering and God who remains silent on the fate of Papuans.</p>
<p>We tip our hats and thank chiefs, church leaders, media, political and government leaders, civil society, and intellectuals, each of ordinary people in the Pacific, and the international solidarity of West Papua in Africa, Australia, Europe, the United States and Indonesia who have been showing true solidarity in the course of the journey of our nation.</p>

<p><em>Suara Papua</em> said the police had arrested KNPB activists, community workers, students and youth in the crackdown.</p>
<p>Police were also reported to have banned journalists covering and taking pictures of the arrests in the capital Jayapura.</p>
<p>The news website published pictures today, clearly taken from under cover.</p>
<p>Indonesian National Police had confirmed arresting a &#8220;number of activists, student activists and well wishers of the people of Papua&#8221;, <em>Suara Papua</em> said.</p>
<p>The arrests of activists mainly occurred in some areas where the KNPB works such as Jayapura , Sentani and Sorong.</p>
<p>An earlier <em>Asia Pacific Report</em> item cited mass arrests of more than 1600 people with both the watchdog <a href="https://westpapuamedia.info/">West Papua Media</a> and <a href="https://twitter.com/hashtag/LiveUpdatesPapua?src=hash">#LiveUpdatesPapua</a> citing heavy arrests.</p>
