“Wherever Palestinians have control is barbaric.” These were the words from New Zealand’s Chief Human Rights Commissioner Stephen Rainbow.

During a meeting with Philippa Yasbek from Jewish Voices for Peace, Dr Rainbow allegedly told her that information from the NZ Security Intelligence Services (NZSIS) threat assessment asserted that Muslims were the biggest threat to the Jewish community. More so than white supremacists.

But the NZSIS has not identified Muslims as the greatest threat to national security.

In the 2023 threat environment report, NZSIS stated that it: “Does not single out any community as a threat to our country, and to do so would be a misinterpretation of the analysis.

“White Identity-Motivated Violent Extremism (W-IMVE) continues to be the dominant IMVE ideology in New Zealand. Young people becoming involved in W-IMVE is a growing trend.”

Religiously motivated violent extremism (RMVE) did not come from the Muslim community, as Dr Rainbow has also misrepresented.

The more recent 2024 NZSIS report stated: “White identity-motivated violent extremism (W-IMVE) remains the dominant IMVE ideology in New Zealand. Terrorist attack-related material and propaganda, including the Christchurch terrorist’s manifesto and livestream footage, continue to be shared among IMVE adherents in New Zealand and abroad.”

To implicate Muslims as being the greatest threat may highlight Dr Rainbow’s own biases, racist beliefs, and political agenda. These false narratives, that have recently been strongly pushed by the US and Israel, undermine social cohesion and lead to a rise in Islamophobia and anti-Palestinian racism.

It is also deeply troubling that he has framed Muslim and Arab communities as potential sources of violent extremism while failing to acknowledge the very real and documented threats they have faced in Aotearoa.

The Christchurch Mosque attacks — the most horrific act of mass violence in New Zealand’s modern history — were perpetrated not by Muslims, but against them, by an individual radicalised by white supremacist ideology.

Since that tragedy, there have been multiple threats made against mosques, Arab New Zealanders, and Palestinian communities, many of which have received insufficient public attention or institutional response.

For a Human Rights Commissioner to overlook this context and effectively invert the victim-aggressor dynamic is not only factually inaccurate, but it also risks reinforcing harmful stereotypes and undermining the safety and dignity of communities who are already vulnerable.

Such narratives are inconsistent with the Human Rights Commission’s mandate to protect all people in New Zealand from discrimination and hate.

The dehumanisation of Muslims and Palestinians
As part of Israel’s propaganda, anti-Muslim and Palestinian tropes are used to justify violence against Palestinians by framing us as barbaric, aggressive, and as a threat. We are dehumanised in order to normalise the harm they inflict on our communities which includes genocide, land theft, ethnic cleansing, apartheid policies, dispossession, and occupation.

In October 2023, Dan Gillerman, a former Israeli Ambassador to the UN, described Palestinians as “horrible, inhuman animals” and was perplexed with the growing global concern for us.

That same month Yoav Gallant, then Israeli Defence Minister, referred to Palestinians as “human animals” when he announced Israel’s illegal and horrific siege on Gaza that included blocking water, food, medicine, and shelter to an entire population, the majority of which are children.

In making his own remarks about the Muslim community being a “threat” in New Zealand as a collective group, and labelling Palestinians being “barbaric”, Dr Stephen Rainbow has shattered the credibility of the Human Rights Commission. He has made it very clear that he is not impartial nor is he representing and protecting all communities.

Instead, Dr Rainbow is exacerbating divisions within society. This is a worrying trend that we are witnessing around the world; the de-humanising of groups to serve political agendas, retain power, or seek public support for war crimes and crimes against humanity.

Dr Rainbow’s appointment also points a spotlight onto this government’s commitment to neutrality and inclusiveness in its human rights policies. Allowing a high-ranking official to make discriminatory remarks undermines New Zealand’s commitment to the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD) and the Universal Declaration of Human Rights.

A high-ranking official should not be allowed to engage in Islamic and Palestinian racist rhetoric without consequence. The public should be questioning the morals, principles, and inclusivity of those currently in power. Our trust is being eroded.

Dr Stephen Rainbow’s comments can also be seen as a breach of human rights principles, as he is supposed to uphold equality and non-discrimination. Yet his beliefs seem to be peppered with racism, often falsely based on religion, ethnicity, and race.

Foreign influence in New Zealand
This incident also shines accountability and concerns for foreign influence and propaganda seeping into New Zealand. The Israel Institute of New Zealand (IINZ) has published articles that some perceive as dehumanising toward Palestinians.

In one article written by Dr Rainbow titled “With every chant Israel’s case grows stronger”, he says:

“The Left has found a new underdog to replace the Jews — the Palestinians — in spite of the fact that the treatment of gay people, women, and political opponents wherever Palestinians have control is barbaric.”

By publicising these comments, The Israel Institute of New Zealand signalled its support of these offensive and racist serotypes. Such statements risk reinforcing a narrative that portrays Palestinians as inherently violent, uncivilised, and unworthy of basic rights and dignity.

This kind of rhetoric contributes to what many describe as anti-Arab and anti-Palestinian racism, and it warrants public scrutiny, especially when shared by organisations involved in shaping public discourse.

Importantly, the NZSIS 2024 threat report stated that “Inflammatory and violent language online can target anyone, although most appears directed towards those from already marginalised minority communities, or those affected by globally significant conflicts or events, such as the Israel-Gaza conflict.”

Other statements and reposts published online by the IINZ on their X account include:

“Muslims are getting killed, is Israel involved? No. How many casualties? Under 100,00, who cares? Why is this even on the news? Over 100,000. Oh, that’s too bad, what’s for dinner?” (12 February 2024)

“Fact. Gaza isn’t ‘ancestral Palestinian land’. We’ve been here long before them, and we’ll still be here long after the latest propaganda campaign.” (12 February 2024)

Palestinian society was also described as being “a violent, terror-supporting, Jew-hating society with genocidal aspirations.” (16 February 2025)

The “estimate of Hamas casualties, the civilian-to-combat death ratio could be as low as 1:1. This could be historically low for urban warfare.” (21 February 2025)

“There has never been a country called Palestine.” (25 February 2025)

Even showing a picture of Gaza before Israel’s bombing campaign with a caption saying, “Open air prison”. Next to it a picture of a completely destroyed Gaza with a caption that says “Victory.” (23 February 2025)

“Palestinian society in Gaza is in my eyes little more than a death loving cult of murderers and criminals of the lowest kind.” (28 February 2025)

Anti-Palestinian bias and racism
Portraying Muslims and Palestinians as a threat and extremist reflects both Islamophobia and anti-Palestinian bias and potential racism. These statements risk dehumanising Palestinians and are typical of the settler colonial narrative used to erase indigenous populations by denying our history, identity and legal claim.

The IINZ has published content that many see as mocking the deaths of Palestinian Muslims and Christians, which is not only ethically questionable but can be seen as a complete lack of empathy.

And posting the horrific images of a completely destroyed Gaza, appears to revel in the suffering of others and contradicts basic ethical norms, such as decency and compassion.

There also appears to be a common theme among pro-Israeli organisations, not just the IINZ, that cast negative connotations on our national symbols including our Palestinian flag and keffiyeh.

In an article on the IINZ webpage, titled “A justified war”, they write “chorus of protesters wearing keffiyehs, waving their Palestinian and terrorist flags, and shouting about Israel’s alleged war crimes.”

It seemingly places the Palestinian flag — an internationally recognised national symbol– alongside so-called “terrorist flags,” suggesting an equivalence between Palestinian identity and terrorism. Many view this language as dehumanising and inflammatory, erasing the legitimate national and cultural characteristics of Palestinians and feeding into harmful stereotypes.

The Palestinian flag represents a people, their identity, and national aspirations.

There is nothing wrong with our keffiyeh, it is part of our national dress. The negative connotations of Palestinian cultural symbols have to stop, including vilifying other MPs or supporters who wear it in solidarity.

This is happening all too often in New Zealand and must be called out and addressed. Our keffiyeh is not just a scarf — it is a symbol of our Palestinian identity, our resistance, and our rich, historic and deeply rooted cultural heritage.

Pro-Israeli groups attack it because they aim to delegitimise Palestinian identity and resistance by associating it with violence, terrorism, or extremism.

In 2024, ISESCO and UNESCO both recognised the keffiyeh as an essential part of their Intangible Cultural Heritage lists as a way of safeguarding Palestinian cultural heritage and reinforcing its historical and symbolic importance.

As a safeguarded cultural artifact, much like indigenous dress and other traditional attire, attempts to ban or demonize it are acts of cultural erasure and need to be called out as such and dealt with accordingly.

In the same IINZ article titled “A Justified War”, the authors present arguments that appear to defend Israel’s military actions in Gaza, including the targeting of civilians.

Many within the community (most of us have been affected), including survivors and those with direct ties to the region, have found the article deeply distressing and feel that it lacks compassion for the victims of the ongoing violence, and the framing and tone of the piece have raised serious ethical concerns, especially as some statements are factually incorrect.

The New Zealand Palestinian communities affected by this unimaginable genocide are suffering. Our family members are being killed and are at threat daily from Israel’s aggression and illegal war.

Unfortunately, much rhetoric from this organisation aligns with Israeli state narratives and includes statements that some view as racist or immoral, warranting further scrutiny from the government.

There is growing public concern over the association of Human Rights Commissioner Dr Stephen Rainbow with the IINZ, which promotes itself as a research and advocacy body.

A Human Rights Commissioner requires neutrality and a commitment to protecting all communities from discrimination; aligning with Israel and publishing harmful rhetoric may lead to bias in policy decisions and discrimination.

It is also important to remember that we are not a monolithic group. Christian Palestinians exist (I am one) as well as Muslim and historically Jewish Palestinians. Christian communities have lived in Palestine for two thousand years.

This is also not a religious conflict, as many pro-Israeli groups wish the world to believe, and it is not complex. It is one of colonialism, dispossession, and human rights. A history that New Zealand is all too familiar with.

The need for accountability
Justice Minister Paul Goldsmith’s inaction and disrespectful response, claiming that a staunchly pro-Israeli supporter can be impartial and will be “very careful” from now on, hints that he may also support some forms of racism, in this case against Muslims and Palestinians.

You cannot address only some groups who are discriminated against but then ignore others, or accept excuses for racist, intolerable actions or statements. This is not justice.

This is the application of selective principles, enforced and underpinned by political agendas, foreign influence, and racism. Does Goldsmith understand that justice is as much about human rights, fairness and accountability as it is about laws?

Without accountability, there is no justice at all, or perhaps he too is confused or uncertain about his role, as much as Dr Rainbow seems oblivious to his?

There needs to be accountability for Goldsmith. Why has he not removed Dr Rainbow from office and acted appropriately? If Dr Rainbow had said that Jews were the biggest threat to Muslims or that Israelis were the biggest threat to Palestinians, would this government and Goldsmith have sat back and said, “he didn’t mean it, it was a mistake, and he has apologised”?

Questions New Zealanders should be asking are, what kind of Human Rights Commissioner speaks of entire peoples this way? What kind of minister, like Paul Goldsmith, looks at that and does very little?

What kind of Government claims to champion justice, while turning a blind eye to genocide? This is betraying the very idea of human rights itself.

Although we are a small country here in New Zealand, we have remained strong by upholding and standing by our principles. We said no to apartheid in South Africa. We said no to nuclear weapons in the Pacific. We said no to the invasion of Iraq in 2003.

And we must now say no to dehumanisation — anywhere. Are we a nation that upholds justice or do we sit on the sidelines while the darkest times in modern history envelopes us all?

The attacks against Palestinians, Arabs and Muslims must stop. We have already faced horrific acts of violence against us here in New Zealand and currently in Palestine. We need support and humanity, not dehumanisation, demonisation and cruelty. This is not what New Zealand is about, we must do better together.

There needs to be a formal enquiry and policy review to see if structural biases exist in New Zealand’s Human Rights institutions. This should also be done across some government bodies, including the Ministry of Education and Immigration NZ, to determine if there has been discrimination or inequality in the handling of humanitarian visas and how the Education Ministry has handled the complaints of anti-Palestinian discrimination at schools.

Communities have particular concern at how the curriculum in many schools deals with the creation of the state of Israel but is silent on Palestinian history.

Public figures should be held to a higher standard, with consequences for spreading racially charged rhetoric.

The Human Rights Commission needs to rebuild trust in our multicultural New Zealand society. The only way this can be done is through fair and just measures that include enforcement of anti-discrimination laws, true inclusivity and action when there is an absence of these.

We are living in a moment where silence is complicity. Where apathy is betrayal.

This is a test of whether New Zealand, Minister Goldsmith and this government truly uphold human rights for all, or only for some.

Two independent Jewish Voices groups in Aotearoa New Zealand have written an open letter to the government condemning the Zionist “colonisation” project leading to genocide and criticising the role of the NZ Jewish Council for its “unelected” and “uncritical support” for Israel.

The groups, Alternative Jewish Voices and Dayenu: New Zealand Jews Against Occupation, have also criticised a scheduled meeting this week between Prime Minister Christopher Luxon and other ministers and the NZJC.

“The NZJC is an extremist voice. Their politics are harmful, and their actions jeopardise the good standing of Jews in Aotearoa,” the open letter said.

“We protest in the strongest terms that Israel’s advocates are being given Prime Ministerial access.”

The alternative voices also appealed to be consulted along with representatives of the Muslim and Palestinian communities “who have lost the most to racism in recent years”.

“Hear us out before you act,” the open letter said.

The full letter (dated 16 February 2025):

We are Jewish New Zealanders, members of Alternative Jewish Voices and Dayenu: New Zealand Jews Against Occupation. We understand that your office has scheduled a meeting this week with the NZ Jewish Council (NZJC) and additional ministers. We object in the strongest terms. The NZJC is unelected coterie, forever uncritically aligned with Israel. That is not the Jewish community.

We have documented in depth that the NZJC is not representative. They are not elected. Their constitution outlines a regional structure for indirect democracy, but much of that structure does not seem to exist.

They are not accountable to the community. Their president has broadcast her intention to “disempower as much as possible” Jews like Alternative Jewish Voices (AJV) members who “raise their voices”.

Several of us attended the Wellington Regional Jewish Council’s last community meeting, in 2021. The meeting roundly disavowed the Jewish Council’s tone and their relentless focus on Israel.

Indeed, the NZJC’s constitution does not even mention Israel or Zionism. The Wellington Regional Jewish Council dissolved itself after that meeting, acknowledging that they have no community mandate. They haven’t been heard from since. So much for regional representation.

Through public and private channels, members of the Jewish community have repeatedly asked the NZJC to embrace some positive, rights-based vision of the future.

Instead, through Israel’s 15-month “plausible genocide” in Gaza, the NZJC’s militarism has only become more overt. Juliet Moses was to share a platform with IDF’s head of infantry doctrine Yaron Simsolo at an Auckland event in March, until Jewish objections drove Simsolo’s session offsite.

This is not solely an issue for the Jewish community. For years, we have protested that the Jewish Council’s related Community Security Group shares politically slanted information about New Zealanders with Israel’s embassy.

They interpret objections to Israel’s occupation as a security threat to the New Zealand Jewish community, and they share their views of individual Palestinian, Muslim and other New Zealanders with a regime accused of genocide against Palestinians. This creates particular risk for Palestinian New Zealanders, should they ever travel to Israel or the Occupied Palestinian Territories to visit family and whānau.

Let us say this clearly: there is nothing essentially Jewish about Zionism. Zionism is a project of colonisation, erasure, apartheid, ethnic cleansing — finally, of genocide. Institutions that wrap their nationalism in our Jewishness are shielding the brutality that we witness daily.

In this country, the NZJC has been a leading voice in the campaign to confuse Jewish with Zionist, enabling decades of oppression in our names.

The NZJC does not serve, represent or account to the Jewish community. How many Jewish New Zealanders would choose a representative who, like NZJC president Juliet Moses, retweets defences of Elon Musk’s Nazi salute?

The NZJC is an extremist voice. Their politics are harmful, and their actions jeopardise the good standing of Jews in Aotearoa. We protest in the strongest terms that Israel’s advocates are being given Prime Ministerial access.

It’s not hard to guess what the NZJC will be asking for: some special “antisemitism regime” that uses our Jewish identity to shield Israel from the directives of the International Court of Justice (ICJ). They will be asking to divorce the Jewish community from our shared mahi of antiracism and our human rights framework. They will be seeking some exceptional status, suppressing principled protest for Palestinian rights and the criminal accountability of Israeli leaders.

That conversation should not take place without representation from the Muslim and Palestinian communities. They are the New Zealanders whose voices are being silenced, and frankly they are the communities who have lost the most to racism in recent years.

Prime Minister, any meeting with the NZJC ought to be recorded in the ministerial diaries as a session with Israel’s ambassadors. And damn it, they will be doing it in our name. We are also the New Zealand Jewish community, and we are so tired of being used this way.

We would like to join your meeting with the NZJC, bringing Jewish diversity into the room. If you will not open this meeting to the real breadth of the Jewish community, then we wish to schedule a second meeting which includes Muslim and Palestinian representation.

We work closely with the Muslim and Palestinian communities in Aotearoa, modelling the change that we would like to see in the Middle East.

Silent Night is a well-known Christmas carol that tells of a peaceful and silent night in Bethlehem, referring to the first Christmas more than 2000 years ago.

It is now 2024, and it was again a silent night in Bethlehem last night, reports Al Jazeera’s Nisa Ibrahim. Not because of peace. But a lack of it.

Israel’s war on Gaza and violence in the occupied West Bank has frightened away visitors who would traditionally visit Bethlehem at this time of year.

Meanwhile, in Gaza City, hundreds of Christians gathered at a church on Christmas Eve, praying for an end to the war that has devastated much of the Palestinian territory.

Gone were the sparkling lights, the festive decorations and the towering Christmas tree that had graced Gaza City for decades.

The Square of the Unknown Soldier, once alive with the spirit of the season, now lies in ruins, reduced to rubble by relentless Israeli air strikes.

Amid the rubble, the faithful sought solace even as fighting continued to rage across the Strip.

“This Christmas carries the stench of death and destruction,” said George al-Sayegh, who for weeks has sought refuge in the 12th century Greek Orthodox Church of St Porphyrius.

“There is no joy, no festive spirit. We don’t even know who will survive until the next holiday.”

‘Christ still in the rubble’
On Friday, the Palestinian theologian and pastor Reverend Munther Isaac delivered a Christmas sermon at the Evangelical Lutheran Christmas Church in Bethlehem, in occupied West Bank — the birthplace of Jesus — called “Christ Is Still in the Rubble.” He said in this excerpt from Democracy Now!:

‘“Never again” should mean never again to all peoples. “Never again” has become “yet again” — yet again to supremacy, yet again to racism and yet again to genocide.

‘And sadly, “never again” has become yet again for the weaponisation of the Bible and the silence and complicity of the Western church, yet again for the church siding with power, the church siding with the empire.

‘And so, today, after all this, of total destruction, annihilation — and Gaza is erased, unfortunately — millions have become refugees and homeless, tens of thousands killed.

‘And why is anyone still debating whether this is a genocide or not? I can’t believe it. Yet, even when church leaders simply call for investigating whether this is a genocide, he is called out, and it becomes breaking news.

‘Friends, the evidence is clear. Truth stands plain for all to see. The question is not whether this is a genocide. This is not the debate. The real question is: Why isn’t the world and the church calling it a genocide?

‘It says a lot when you deny and ignore and refrain from using the language of genocide. This says a lot. It actually reveals hypocrisy, for you lectured us for years on international laws and human rights. It reveals your hypocrisy.

‘It says a lot on how you look at us Palestinians. It says a lot about your moral and ethical standards. It says everything about who you are when you turn away from the truth, when you refuse to name oppression for what it is. Or could it be that they’re not calling it a genocide?

‘Could it be that if reality was acknowledged for what it is, that it is a genocide, then that it would be an acknowledgment of your guilt? For this war was a war that so many defended as “just” and “self-defense.” And now you can’t even bring yourself to apologise . . .

‘We said last year Christ is in the rubble. And this year we say Christ is still in the rubble. The rubble is his manger. Jesus finds his place with the marginalised, the tormented, the oppressed and the displaced.

‘We look at the holy family and see them in every displaced and homeless family living in despair. In the Christmas story, even God walks with them and calls them his own.’

Story of Jesus one of oppression
“Pastor Isaac joined journalist host Chris Hedges on a special episode of The Chris Hedges Report to revisit the story of Christmas and how it relates to Palestine then and now.

He wasted no time in reminding people that despite the usual jolly associations with Christmas, the story of Jesus Christ was one of oppression, one that involved the struggle of refugees, the rule of a tyrant, the witnessing of a massacre and the levying of taxation.

“To us here in Palestine,” Reverend Isaac said the terms linked to the struggle “actually make the story, as we read it in the Gospel, very much a Palestinian story, because we can identify with the characters.”

Journalist Hedges and Reverend Isaac invoked the story of the Good Samaritan to point out the deliberate blindness the world has bestowed upon the Palestinians, particularly in Gaza in the midst of the ongoing genocide.

The conclusion of the [Good Samaritan] story is that there is no us and them, Reverend Isaac told Hedges.

“Everybody is a neighbour. You don’t draw a circle and determine who’s in and who’s out.”

It was clear, Reverend Isaac pointed out, “the Palestinians are outside of the circle. We’ve been saying it — human rights don’t apply on us, not even compassion.”

Pope calls for ‘silence of arms’ in Gaza
In his Christmas “Urbi et Orbi” (to the city and world) address yesterday at the Vatican, Pope Francis denounced the “extremely grave” humanitarian situation in Gaza while appealing for the release of captives and a ceasefire in the war-torn coastal enclave.

He also appealed for peace in Ukraine and Sudan, reports Al Jazeera.

“I think of the Christian communities in Israel and Palestine, particularly in Gaza, where the humanitarian situation is extremely grave. May there be a ceasefire, may the hostages be released and aid be given to the people worn out by hunger and by war,” he said.

Israel has killed at least 45,361 Palestinians in its war on Gaza and wounded 107,803 since October 7, 2023, the day a Hamas-led operation was launched into Israel during which 1,139 people were killed and about 200 were taken captive.

Hours ago, the news media reported that Israel has attacked Iran. The Freedom Flotilla Coalition publicly declared that it is reminding the world that with all the escalation between Israel and Iran, the killing is still going on in Gaza.

“While those two countries go back and forth, we cannot let Israel distract the world from what is causing far more death, disease, and destruction — Israel’s policies of starving and continued bombardment of unarmed Palestinians in Gaza, mostly women and children,” said the Freedom Flotilla.

Hundreds of civilians from dozens of countries — including Aotearoa/New Zealand — have been meeting in Istanbul, Turkiye, to prepare to sail soon for Gaza, carrying thousands of tonnes of life-saving food and medicine, said Kia Ora Gaza, one of the flotilla coalition members, in a statement.

Three New Zealand doctors are among the international participants.

The flotilla aims to break Israel’s unlawful siege of Gaza and demand an immediate ceasefire to save the lives of thousands of Palestinians.

Participants from 30 countries will be on board, including 40 Americans.

Elliot Adams, former president of Veterans for Peace and a former US paratrooper, called out the complicity of his own government in supporting Israel’s genocidal aggression:

“Israel is trying to ethnically cleanse Palestinians from Gaza, with US support, through starvation as well as direct violence.

“This is a humanitarian crisis and we have got to try to stop it by breaking the siege.”

Israeli ‘bombs, bullets killing’
Former Barcelona mayor Ada Colau said: “Israeli bombs and bullets are killing Palestinians in Gaza every day and their illegal siege is deliberately starving everybody else.”

She said she was joining the nonviolent flotilla “because our governments are not listening to the people’s demand to stop Israel’s barbaric crimes against humanity.”

Argentinian surgeon Carlos Trotta, who has worked with Médecins Sans Frontières/Doctors Without Borders (MSF) across the world, including in Gaza, said that the health situation for Palestinians in the besieged Strip was at a crisis point:

“It’s an emergency. Children are dying of malnutrition, patients have their limbs amputated without anesthesia, and thousands are at risk of dying from the spread of infectious disease, all because of Israel’s arbitrary restrictions on aid arriving in Gaza.

“It is critically important for this flotilla to act right now to help prevent even more loss of life.”

Participants will undergo non-violence training for the next three days.

During that time they will review potential scenarios and learn various strategies and tactics to protect themselves and each other in the event of any attacks.

Departing next week
The flotilla will depart next week carrying more than 5000 tonnes of humanitarian aid on a cargo ship, accompanied by two passenger ships.

Huwaida Arraf, a human rights lawyer and Freedom Flotilla organiser, said: “Israel’s current siege on Gaza, as well as its 17-year-long blockade are forms of collective punishment, which is a war crime.

“As the siege and blockade are illegal, Israel has no right to attack or stop our ships.

“We call on our governments, which have thus far done nothing to protect the Palestinian people or compel Israel to abide by international law, to start living up to their obligations and demand our flotilla have safe passage to Gaza.

“We ask people around the world to join us in this call.”

In 2003, the International Court of Justice ruled that Israel’s “apartheid wall” being built through Palestinian territory was a violation of international law and should be dismantled. Israel ignored the ruling and more than 20 years later the wall remains a potent symbol of Israeli policies of segregation based on ethnicity.

Last December, Israel was taken to the court again, this time by South Africa which argued Israel was committing genocide against the Palestinian people in Gaza with genocidal talk from Israeli leaders and indiscriminate killing of civilians — more than 27,000 killed so far including more than 12,000 Palestinian children.

The charge of genocide against Israel will take years to be heard and decided upon but in the meantime South Africa argued for the court to issue interim orders to require Israel to end its military operation and allow desperately needed humanitarian assistance to flow freely into Gaza.

Last month, the ICJ gave an interim ruling and although it did not demand an immediate ceasefire, it agreed with South Africa’s case that there was evidence to suggest Israel had breached the Genocide Convention and requiring Israel to report back to the court within a month on the steps it was taking to protect Palestinian lives and their very existence in Gaza.

Israel is now on probation. What happens in the coming weeks will determine whether Israel ends its killing spree in Gaza or shows the ICJ its middle finger as it did in 2003.

Commentary on the ICJ decision indicates the huge moral weight the decision carries for Israel and its small coterie of supporters, including New Zealand, which has been complicit through its silence, to end the war on Gaza.

The only way Israel will follow the ICJ ruling is if it comes under enough pressure from countries such as New Zealand.

Strong demand or look away?
Western countries have previously called on other countries to abide by ICJ rulings — such as the ruling which said Russia must end its war in Ukraine. Will we make the same strong demand of Israel or will we look the other way?

So far New Zealand has been equivocal, Foreign Minister Winston Peters making a few obligatory tweets but nothing more. The contrast with how we dealt with Russia compared with Israel could not be clearer.

The Foreign Minister’s stance seems more aimed to avoid difficult conversations with US representatives at diplomatic cocktail parties than pressure to end the killing of Palestinian children.

With Israel’s history of ignoring international law, New Zealand must speak out in a principled, assertive way. The alternative is to be silent and for this country to suffer derision for such cowardly, obsequious behaviour.

Already New Zealand is swimming against the tide of world opinion. We have refused to criticise the killing of Palestinian civilians by Israel despite loudly condemning the killing of Israeli civilians in the October 7 attack.

We have also refused to condemn other war crimes such as the “collective punishment” of Palestinians through the withholding of food, water and other necessities of life. We haven’t even made an unequivocal call for an immediate, permanent ceasefire or called for an International Criminal Court investigation into war crimes on and after October 7.

We did this for Russia’s invasion of Ukraine, so why the reticence over the Middle East?

NZ’s selective morality
Our embarrassing history is one of selective morality. In 2014 when Israel launched a war on Gaza with similar mass killing of Palestinians, the John Key government called in the Israeli ambassador and made clear New Zealand’s expectations. The Christopher Luxon-led government has failed to take even this most rudimentary measure.

The time for doing that is well past. We must indicate to Israel that its behaviour is morally and ethically reprehensible.

The government should immediately close the Israeli embassy until Israel is in full compliance with the ICJ decision as well as the broader provisions of international law such as allowing Palestinian refugees the right to return to their land and homes in Palestine, ending the military occupation and ending Israel’s apartheid policies against Palestinians.

Wringing our hands is not an option. It might be acceptable for the comfort of the Minister of Foreign Affairs but for Palestinians it means ongoing death and destruction.

As Newsroom has reported, 15 aid agencies have joined forces to call on the Aotearoa New Zealand government to do more to encourage an immediate and sustainable ceasefire in Gaza, in the wake of the International Court of Justice (ICJ) decision.

Those 15 agencies are joining an international and increasingly loud chorus of calls for an immediate ceasefire.

I would go further, and remind the government that whatever it thinks of last month’s ICJ ruling, New Zealand has a number of international legal obligations to inform its response to Israel’s military attack on Gaza.

As most international commentary has highlighted, even fixated on, the ICJ did not order a ceasefire as South Africa requested. But the fact that it didn’t is a manifestation of how constrained the court was.

Despite its lofty title, the ICJ (sometimes referred to as the “World Court”) isn’t a “world” court in any meaningful sense of the word. It only has jurisdiction to consider issues in cases where countries have explicitly agreed to the court’s authority over them.

In this current litigation, the court was able to consider the case only on the basis that both South Africa and Israel are States Parties to the Genocide Convention. That meant South Africa had to frame its application through a “genocide lens”, and that the court had no power to go beyond the obligations arising out of that treaty. This jurisdictional conundrum partly explains why the court did not order a ceasefire — it didn’t have the authority to do so.

It also partly explains why the court could not order Hamas to release the remaining Israeli hostages. Hamas was not a party to the proceedings (the court can only hear proceedings on disputes between states), and despite the claim by Israel in its oral pleadings, the hostage taking by Hamas and their subsequent mistreatment and killing didn’t “plausibly”, according to the court, meet the threshold of genocide.

But the court did order Israel to take all measures in its power to prevent genocide, and ordered Israel to enable the provision of urgently needed basic services and humanitarian assistance to address the adverse conditions faced by Palestinians in Gaza.

Orders fall within ‘genocide jurisdiction’
These orders fall within the “genocide jurisdiction” because the treaty defines genocide as not only direct killing, but also “deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part”.

An immediate ceasefire would go a long way toward Israel complying with these orders so the calls for a ceasefire are well made, despite the court not having the power to order one.

What is New Zealand’s role in all this? What are the moral and legal responsibilities it has and should fulfil?

In its decision, the court (re)confirmed that all states parties to the Genocide Convention have a “common interest” in ensuring the prevention, suppression, and punishment of genocide. That includes New Zealand, which has a legal obligation to do what it can to ensure that Israel complies with the court’s orders.

This is not a question of New Zealand’s choice of foreign policy, but a legal obligation.

The second relevant international obligation for New Zealand arises from international humanitarian law (IHL) — the body of law which governs the conduct of war, and which includes prohibitions against the direct targeting of civilians, causing superfluous injury and unnecessary suffering, the taking of hostages, the use of “human shields” and engaging in indiscriminate attacks on civilians and civilian infrastructure.

These rules don’t just apply to the parties directly involved in any given conflict — in this instance, Israel and Hamas. The relevant treaties stipulate all states have a shared responsibility “to ensure respect” for these rules. That responsibility exists independently of the lack of ICJ jurisdiction to consider these matters.

Must act in good faith
There is a third legal obligation for New Zealand in the wake of these orders.  Although decisions of the court are only binding as between the parties to a case (here South Africa and Israel), as a member of the United Nations, New Zealand has a legal obligation to act in good faith towards the court, being one of the organs of the UN and its principal legal body.

This obligation aligns with New Zealand’s self-professed commitment to the international rule of law.

Thus, regardless of political preferences and whether the current government agrees or disagrees with the court’s findings, the findings have been made and New Zealand ought not undermine the court or the international rule of law.

Governments of all political persuasions repeatedly pronounce that a small nation such as ours depends on the international rule of law and a rules-based international order.

Now is the time for New Zealand to step up and defend that order, even if it feels uncomfortable, even if it annoys some of our “friends” (such as the US). We are legally obliged to step up and speak out.

Major media organisations all over the world are copping criticism for the way they’re reporting what’s happening in Gaza and Israel. Mediawatch has asked BBC news boss Jonathan Munro how they’re handling it — even when it’s coming from the UK’s own government.

“Palestinian health officials in Gaza say hundreds of people have been killed in an explosion at a hospital in Gaza. They’re blaming an Israeli strike on the hospital.

“But the Israel DefenCe Forces said an initial investigation shows the explosion was caused by a failed Hamas rocket launch.”

That was how RNZ’s news at 8am last Tuesday reported the single deadliest incident of this conflict so far — and likely to be the deadliest one in all of the five times Israel and Hamas have fought over Gaza so far.

The Israeli Defence Force also singled out Islamic Jihad for the atrocity — but the absence of hard evidence put the media reporting it in a difficult position.

“It’s still absolutely unclear. There are varying bits of information that are coming out for now. I don’t think anybody can quite say . . . it’s most likely to have been Israel,” the BBC Middle East editor Sebastian Usher told RNZ on Wednseday night.

“They said it seems like it might be a misfired rocket,”

Huge anger on streets
“We can’t say for now, but I don’t think  — in terms of the mood in the Arab world and the Middle East — that that really matters. People out on the streets are showing huge anger and they will reject any investigation, any Israeli claim, to say that Israel is not responsible,” he said.

Reporting those claims and counterclaims creates confusion among the audience. It’s also stoked the anger of those objecting to reporters’ choice of words.

CNN’s Clarissa Ward, for example, was criticised heavily on social media for mentioning the Israeli Defense Force claims — and then expressing doubt about them at the same time.

A video showing a pro-Palestinian protester calling Clarissa Ward “a puppet” has gone viral on social media. So did another falsely accusing her of faking a rocket strike.

Her CNN colleague Anderson Cooper was also criticised online for referring to a huge civilian loss of life during the live report from Tel Aviv in Israel and repeating himself, but then without the word “civilian”.

Among those who, alongside expert investigators, tried to sift the available evidence and cut through the information war was Alex Thompson, correspondent for UK broadcaster Channel Four

“Israel and Hamas can tweet what they like. The truth of what happened here requires independent expert investigation — not happening,” was Alex Thompson’s bleak conclusion.

‘A fierce information war’
“Any doubt is due to a fierce information war that in truth matters little to the victims of the Gaza hospital tragedy,” another British correspondent — ITV Jonathan Irvine — said on Newshub at 6 last Tuesday.

At times, broadcasters have used the wrong words and given audiences the wrong idea.

Last week the BBC’s main evening news bulletin made a rapid apology for describing pro-Palestine protests in the UK as “pro-Hamas”.

“We accept that this was poorly-phrased and was a misleading description,” the presenter told viewers just before the end of the bulletin.

And earlier this month, people protested outside the BBC News headquarters in London about the BBC’s long-standing policy of not labeling any group as “terrorists”.

“You don’t seem to be particularly interested. If the BBC seems to refuse to call terrorists even though the British Parliament has legislated them terrorists — that is a question I haven’t heard the BBC answer yet,” UK government Defence Secretary Grant Shapps told the BBC radio flagship news show Today.

“Have you not seen any of the coverage on the BBC of the atrocities, the dead, the injured, the survivors?” the startled presenter asked him.

“How can you say that we’re not interested?” she replied, when Shapps said he had.

An obligation to audiences
The BBC’s deputy chief executive of news Jonathan Munro was at Sydney’s South by Southwest festival this week to talk about how the BBC delivers news from and about conflict zones.

“We’ve already seen journalists lose their lives in this country, working for organisations who are also facing the same dilemmas as we are,” said Munro, who is also the BBC’s director of journalism.

“We’ve got an obligation to audiences to explain what’s going on and that involves lots of people on the ground as witnesses to events, but also the analysis that comes with expert knowledge,” he told Mediawatch.

“Expertise is just invaluable. People like Jeremy Bowen (former Middle East editor and current international editor of BBC News) and our chief international correspondent Lyse Doucet and correspondents who are based in that region,” he said.

“But the main story here is the catastrophic loss of life and the appalling conditions that people are living in and that the hostages are being held in — the humanity of that,” he said.

A lot of reporting people will see, hear and read will come from Israel. Reporting from Gaza itself is difficult and dangerous — and access to Gaza at the border is restricted by Israel.

“We have a correspondent in Gaza, but he’s moved from Gaza City to Khan Yunis in the south of the strip, a safer option. But he can’t report 24 hours a day, and he is looking after his family which is paramount.

Need for transparency
“So we do have to add to that [with] reporting from Israel and from London by people who know Gaza very well,” he said.

“We have to be transparent about that and tell the audience and then the audience knows that wherever it’s coming from, and you still hold editorial integrity.”

A lot of what people will be seeing from Gaza is amateur footage and social media content that’s very difficult to verify.

The BBC recently launched BBC Verify, dedicated to checking out this kind of material and vetting its use.

“There’s a huge amount of video out there on social media we can all find at the touch of a button. The brand of BBC Verify is a signpost that the material . . . has been checked by us using methods like geolocation and looking at the metadata,” he said.

Even when verified, there are still ethical dilemmas.

For example, BBC Verify used facial recognition software to analyse images of an individual in the Hamas surprise attacks on October 8. It identified one gunman as a policeman from Gaza.

Independently verifying claims
“It’s case-by-case — but something shouldn’t go out on the BBC without us knowing it’s true. There are occasions we would broadcast something and we would tell the audience that we’ve not been able to independently verify a claim . . . and we need to caveat our coverage of the reaction to it with the fact that we do not have our own verification of source material,” he said.

Even before the Al Ahli hospital catastrophe amplified emotions, intense scrutiny of reporters’ work was adding to the stress of those reporting from the region.

“Every word you say is being scrutinised so closely and is likely to be contested by one side or the other more or both — and that definitely adds to the pressure,” Channel Four correspondent Secunder Kermani told the BBC’s Media Show last week from Gaza.

“In the Israel Gaza situation it is critical. Every word can be checked and rechecked and double checked for any implication which is either inferred or implied by accident.

“Because our job is to be impartial, tell the reality of the story, and most importantly, share the witnessing of that story by our correspondents,” Jonathan Munro told Mediawatch.

“That’s why we’ve got a significant number of correspondents in Israel and back in the newsroom in London are adding explanations and leaning into that scrutiny on language,” he said.

Adjectives ‘can be dangerous’
“We’re using expertise, our knowledge as an organisation and we’re making sure that at every stage of that every sentence, every paragraph is reflective of what we know to be true.

“But adjectives can be dangerous, because they may imply something which is more emotive than we mean. We have to be quite clean in our language in these circumstances,” he said.

“Of course, people can come on the BBC and express their views in language of their choice. All of those things help to keep our coverage straight and honest and ensure that correspondents on the ground aren’t in danger by slips or mistakes that are made in good faith elsewhere in the BBC output.”

Last week at its annual conference, senior members of the Conservative Party — which is in power in the UK — heavily criticised the BBC for alleged bias and elitism. Some — including home secretary Suella Braverman and former prime minister Liz Truss made a point of praising GB News — the new right-wing TV channel backed by billionaire Brexiteers — for disrupting the news.

“The criticism of the BBC from politicians is as old as the BBC itself. Just because they’re habitual critics doesn’t mean they’re wrong, but we’ve got a well developed set of editorial guidelines which have stood the test of time over many, many difficult stories,” Munro told Mediawatch. 

“The editorial guidelines are robust and public. You can go online and look at them. All of our journalism abides by those guidelines and if you have guidelines that you believe in as an organisation, that’s a significant defence to some of the less well-founded attacks that we sometimes find ourselves on the end of,” he said.

American President Joe Biden is among the latest Western politicians to land in Tel Aviv in a show of support to Israel.

As Israel’s primary backer, the United States has sent two aircraft carriers to the region and indicated it could deploy 2000 American troops to Israel.

Biden was also set to meet Palestinian and Arab leaders in the Jordanian capital Amman. But Jordan cancelled the meeting after a reported airstrike on October 17 killed about 500 people at a Gaza hospital.

In the days after Hamas launched Operation Al-Aqsa Flood against Israel, European and North American governments (with few exceptions) were quick to provide a unified and consistent message of support for Israel.

That message contains at least four interconnected elements:

• Israel is the victim of an unprovoked terrorist attack;
• Israel has the right to defend itself;
• The West fully stands with Israel against the barbaric and wanton violence of the Palestinians; and
• Hamas is to blame (either partially or fully) for all civilian deaths on both sides since they began these hostilities and forced Israel’s hand while hiding behind civilians.

Palestinians erased
There are a few important features of this message, but I want to focus on two that highlight the West’s double standards.

First, is the advancement of anti-Palestinian racism in the West. It is critical to underscore a salient feature of anti-Palestinian racism: the silencing of the Palestinian critiques of Zionism and Israel.

This is a dynamic which has its roots in the Nakba (Arabic for “catastrophe”) and erases Palestinian voices, history, presence, aspirations and identity from public discourse.

Political, media and educational institutions in the West regularly sideline and silence Palestinians and their supporters. This is not just an issue among the right-wing or even centrists, but occurs across the political spectrum.

Left-wing politics, including progressive spaces, that purport to be anti-racist often remain hostile to Palestinian voices

Here in Canada, a statement by progressive Toronto Mayor Olivia Chow painted a rally in support of Palestinians as allegedly supporting violence and as a threat to the safety and security of Canadian Jews. That statement is still up on her X account.

This is precisely the anti-Palestinian narrative that has permeated in the West for years: that all support for Palestine is inherently violent and driven by antisemitic hatred of all Jews. Thus, in the name of anti-racism, Palestinians and their supporters are denounced and even criminalised.

Differing reactions to civilian death
Second, the double standard is on display in the reactions we have seen to the killing of Israeli civilians and the reactions — or lack thereof — to the killing of Palestinian civilians. Many are rightly highlighting Western hypocrisy by drawing comparisons to how the West responded to Russia’s war on Ukraine.

We need to look at how Western governments have responded to the killing of Israeli civilians versus the killing of Palestinian civilians. For the Israeli state and Israeli victims, political, military, economic, cultural and social institutions have fully mobilised to provide support.

The same is entirely absent for the Palestinians. For the Palestinians, there are no evacuations. Aircraft carriers are not sent to provide military support. Mainstream political and cultural discourse does not humanise Palestinian life and mourn Palestinian death.

Aid relief is withheld and used as a bargaining counter. Economic support is not forthcoming. Institutions do not send Palestinians messages of support.

In some ways, this silence is not surprising. No one expressing support for Israel risks losing their livelihood. Many who have voiced solidarity with Palestinians have lost their jobs, been rebuked, suspended and faced doxing.

Western self-interest
States are not moral entities, but act purely in self-interest. Palestinian freedom and liberation does not align with the interests of the US-led West.

Therefore, Western institutions repeat the increasingly weak talking point that “terrorism” is the cause of all the violence. This talking point is used to provide Israel with the green light to unleash uninhibited violence against Palestinians in the Gaza Strip, West Bank and Jerusalem.

The idea that Western governments and institutions are horrified by violence against civilians rings hollow because of their silence when it comes to violence against Palestinian civilians and other groups around the world.

For decades, Palestinians have been expelled from their land, killed and maimed in great numbers, including in mass atrocities and many well-documented cases of sexual violence and torture in Israeli prisons.

This only scratches the surface of the violence that Palestinians continuously experience, and have experienced, since well before Hamas was formed.

I’m confused. When Ukrainians attacked back after Russia’s invasion, the US celebrated them. When Palestinians do the same against Israeli occupation, they’re condemned.

Palestinians continue to suffer what Palestinian scholars Nahla Abdo and Nur Masalha have called an ongoing Nakba and genocide of the Palestinian people. Yet, when Palestinians suffer, as they are now in Gaza, what Israeli historian and expert on genocide Raz Segal has called “a textbook case of genocide,” Western governments remain silent.

There was no Western outrage when Israel ordered more than a million Palestinians to leave their homes in 24 hours. In February, Israeli settlers went on an hours-long rampage in the Palestinian town of Huwara after two settlers were shot by a Palestinian.

Western condemnations of the rampage were muted or non-existent.

Hundreds of scholars and practitioners of international law, conflict studies and genocide studies are now sounding the alarm about the possibility of genocide being perpetrated by Israeli forces against Palestinians in the Gaza Strip.

The stories of Palestinian lives that end with the sudden drop of a bomb are not told. Palestinian voices that explain the settler colonialism they suffer remain sidelined. And Palestinian aspirations for decolonised liberation are denied.

The West’s institutional reaction is not just hypocritical, it is an expression of where Western governments stand on the question of Palestine. The West is an active participant in the erasure of Palestine, and when moments of intensified violence like this happen, the West’s true position becomes clear for all to see.

However, people power across the world, including in the US, provide reason for hope. Increasingly, many in the West are disgusted and ashamed by the erasure of Palestine and the killing of Palestinian civilians.

More people are joining the protests and calling for the siege on Gaza to be lifted once and for all. More people power is needed to demand that governments do everything they can to resolve this issue, which can only begin to move towards peace and justice when the Palestinian people are free.
