<p>The New Zealand government is shortly to announce whether it will designate Hamas a “terrorist” group in response to the October 7 attack on Israel in which Hamas was involved.</p>
<p>The US and most of the Western world calls Hamas “terrorists” but so far New Zealand has only designated the armed wing of Hamas as a terrorist group.</p>
<p>More importantly, the United Nations &#8212; along with most of the rest of the world &#8212; has not taken this step and neither should New Zealand.</p>

<p>It is for Palestinians to decide which groups they support in their struggle for self-determination but it’s important here to respond to the incessant, hysterical lies told about Hamas by Israel and the pro-Israel lobby around the world.</p>
<p>There are probably more lies spoken about Hamas than any other organisation in the world.</p>
<p>One of these is the lie that the Hamas Charter calls for the destruction of Israel and the murder of Jews worldwide. (For example, this was claimed in an <a href="https://www.thepost.co.nz/nz-news/350142765/how-hamas-has-weaponised-meaning-genocide">opinion piece in <em>The Post</em> newspaper</a> recently by Israeli diplomat and former ambassador to the United Kingdom Daniel Taub  &#8212; in response to which the newspaper declined to print any letters)</p>
<p>The truth is that in the latest Hamas charter from 2017, the organisation says</p>
<blockquote><p>“Hamas reiterates that its conflict is with the Zionist project and not with the Jews based on their religion.”<br />
“Hamas is not fighting against the Jews because they are Jews, but against the Zionists who are occupying Palestine.”<br />
“Hamas rejects the persecution of people or the undermining of their rights on nationalist, religious or sectarian ground.”</p></blockquote>
<p><strong>Hamas accepts Israel with 1967 borders</strong><br />
In fact, their new charter goes further and <a href="https://www.aljazeera.com/news/2023/10/8/what-is-the-group-hamas-a-simple-guide-tothe-palestinian-group">Hamas accepts the state of Israel based on 1967 borders</a> &#8212; precisely the same policy as the New Zealand government along with the US, the UK and most of the world!</p>
<p>It is clear to everyone that war crimes were committed in the October 7 attack on Israel.</p>
<p>Killing civilians and taking civilian hostages are war crimes under the Fourth Geneva Convention and should be condemned.</p>
<p>These crimes should be investigated by the International Criminal Court as were crimes in the Russian invasion of Ukraine. Those investigations resulted in arrest warrants issued against Russian leader Vladimir Putin.</p>
<p>The same process should be followed for the October 7 attack on Israel and Israel’s genocidal response. For example, arrest warrants should be issued by the ICC against Israeli Prime Minister Benjamin Netanyahu and at least half his cabinet for war crimes and crimes against humanity &#8212; including the crimes of genocide and apartheid.</p>
<p>As things stand there were eight Palestinian resistance groups involved in the October 7 attack on Israel and we simply do not know yet which groups and leaders were responsible for war crimes.</p>
<p>Palestinian resistance groups have the right under international law to take up arms to fight against their colonial occupiers just as the African National Congress (ANC) had the right to take up arms to fight for freedom in apartheid South Africa.</p>
<p>Aotearoa New Zealand must respect this right and not pander to the deep-seated racism and cheap political sloganeering of the pro-Israel lobby.</p>
<p>A knee-jerk reaction from New Zealand to designate Hamas a terrorist group would be a further step backwards from an independent foreign policy.</p>

<p>Aotearoa New Zealand Prime Minister Chris Hipkins is correct to condemn Hamas killing Israeli civilians in its attacks on Israel this week.</p>
<p>The killing of civilians or taking them hostage is a war crime under the Fourth Geneva Convention and should be universally condemned.</p>
<p>However, the Labour government has been deathly silent on the war crimes committed by Israel against Palestinians under Labour’s watch these past six years.</p>

<p>Under his prime ministerial watch this year, Chris Hipkins has looked the other way while Israel has built more illegal Israeli settlement homes on Palestinian land; killed more than 250 Palestinian civilians; supported Israeli settler pogroms against Palestinian towns and villages across the occupied West Bank and encouraged highly-provocative Israeli ministerial and settler incursions into the Al Aqsa compound in occupied East Jerusalem.</p>
<p>Why does he only wake up when Israelis are killed? Why does he think Israeli lives are more important than Palestinian lives?</p>
<p>The Prime Minister’s pro-Israel stance is one-sided and blatantly racist.</p>
<p>New Zealand, along with other Western countries, bears heavy responsibility for the deaths of Palestinians and Israelis in recent days because we have never held Israel to account for its crimes against the Palestinian people.</p>
<p>We have given Israel a free pass to murder and abuse Palestinians and this led to the inevitable tragedy last weekend.</p>
<p>It is precisely the attitude of Western leaders such as our Prime Minister which has meant so many lives have been lost.</p>
<p>The Prime Minister has the blood of Palestinians and Israelis on his hands.</p>

<p><strong>The besieged Gaza Strip</strong><br />
The Palestinian enclave &#8212; home to about 2.3 million people &#8212; has been under an Israeli air, land and sea blockade since 2007, <a href="https://www.aljazeera.com/news/2023/10/9/is-total-gaza-blockade-a-collective-punishment-against-palestinians">reports Al Jazeera</a>.<br />
More than 100,000 Palestinians in Gaza have been displaced and thousands have taken shelter in UN schools as Israeli attacks intensify, forcing Palestinians to flee their homes.</p>
<p>Buildings, mosques and offices have been targeted as Netanyahu promised “mighty vengeance” for the deadly attacks that has sent shockwaves across Israel.</p>
<p>Harrowing images from inside Gaza have emerged with 19 members of a family killed when an air strike on Sunday hit their residential building. More than 60 percent of Gaza’s population are refugees who were ethnically cleansed from their homes currently in Israel.</p>
<p>Israel has maintained a land, sea and air blockade on Gaza since 2007, a year after Hamas was democratically elected into power. The voting came nearly two years after Israeli troops and settlers withdrew from the enclave.</p>
<p>The blockade gives Israel control of Gaza’s borders, and Egypt has stepped in to enforce the western border.</p>
<p>Israel has stated it has blocked the borders to protect its citizens from Hamas, but the act of collective punishment violates the Geneva Conventions and has long been considered illegal by groups including the International Committee of the Red Cross.</p>

<p>Israel&#8217;s fatal shooting of leading Al Jazeera reporter <strong>Shireen Abu Akleh</strong> as she covered clashes in the West Bank city of Jenin is a serious violation of the Geneva Conventions and UN Security Council Resolution 2222 on the protection of journalists, says the Paris-based media freedom watchdog <a href="https://rsf.org/en/index">Reporters Without Borders (RSF)</a>.</p>
<p>It has called for an independent international investigation into her death as soon as possible.</p>
<p>Witnesses said Abu Akleh, a Palestinian American, was killed by a shot to the head although she was wearing a bulletproof vest with the word “PRESS” that clearly identified her as a journalist.</p>

<p><strong>Ali al-Samudi</strong>, a Palestinian journalist working as an Al Jazeera producer who was beside her at the time, was also targeted, sustaining a gunshot wound in the back, RSF reported.</p>
<p>Samudi, who is now in hospital, said in a video: “We were filming. They did not ask us to stop filming or to leave. They fired a shot that hit me and another shot that killed Shireen in cold blood.”</p>
<p>Following Abu Akleh’s death, Israeli security forces raided her East Jerusalem home as her family was making arrangements for her funeral.</p>
<p>Her body was transferred to Nablus for an autopsy prior to be taken to Jerusalem, where her funeral took place yesterday in emotional scenes with massive crowds. She was buried beside her parents in Mount Zion.</p>
<p>Israeli riot police attacked the pallbearers and a hearse carrying her coffin in the peaceful march, and ripped away Palestinian flags. International protests have followed this latest attack.</p>
<p><strong>Popular in Middle East</strong><br />
Abu Akleh was very popular in the Middle East and was respected by fellow journalists for her experience in the field.</p>
<p>Al Jazeera issued a statement accusing the Israeli security forces of “deliberately” targeting Abu Akleh and of killing her “in cold blood.”</p>

<p>The Israel Defence Forces announced an investigation into her death, but IDF spokesman Amnon Shefler said Israeli soldiers &#8220;would never deliberately target non-combatants&#8221;.</p>
<p>Several witnesses, including an AFP photographer, denied seeing any armed Palestinians at the place where Abu Akleh was killed. Palestinian Authority president Mahmoud Abbas said he held the Israeli authorities “fully responsible” for her death.</p>
<p>“RSF is not satisfied with Israeli Foreign Minister Yair Lapid’s proposal of a joint investigation into this journalist’s death,” said RSF secretary-general Christophe Deloire.</p>
<p>“An independent international investigation must be launched as soon as possible.”</p>
<p>The shooting of these two Palestinian reporters during an IDF “anti-terrorist operation” in Jenin is the latest of many disturbing cases.</p>
<p><strong>Two journalists fatally shot</strong><br />
In the spring of 2018, two Palestinian journalists were fatally shot by Israeli snipers while covering the weekly “Great March of Return” protests near the Israeli border in the Gaza Strip.</p>
<p>Also in 2018, Ain Media founder <strong>Yaser Murtaja</strong> was killed on the spot on March 30, while Radio Sawt al Shabab reporter <strong>Ahmed Abu Hussein</strong> died in hospital on April 25 from the gunshot injury he suffered on April 13.</p>
<p>According to RSF’s tallies, more than 140 journalists have been the victims of violations by the Israeli security forces on Friday&#8217;s marches since 2018, and at least 30 journalists have been killed since 2000.</p>
<p><strong>Israel</strong> is 86th in the RSF <a href="https://rsf.org/en/index">2022 World Press Freedom Index</a>, and <strong>Palestine</strong> is 170th.</p>

<p>The discovery of many civilian bodies lying dead in the <a href="https://en.wikipedia.org/wiki/Bucha_massacre">Ukrainian city of Bucha</a> this week has brought out more Western rhetoric of horror, disgust, anger and fury at the Russian invasion of Ukraine and has renewed calls for more sanctions against Russia, more weapons to the Ukrainians and calls for Putin to be put on trial as a war criminal.</p>
<p>That’s a strong response to war and those responsible for starting a military invasion of a sovereign state.</p>
<p>Let’s shift the focus to Iraq in 2003 for a moment.</p>

<p>On the marches to protest against the US-UK-Australian-led invasion of Iraq in 2003 one of the chants used was “Never forget Fallujah!”.</p>
<p>So, for those that were too young to know, or now too old to remember, here are a few well-referenced <a href="https://en.wikipedia.org/wiki/Fallujah">paragraphs from Wikipedia</a> about what happened when the US invaders attacked that city as part of an invasion of another sovereign state, Iraq.</p>
<p><em>The United States bombardment of Fallujah began in April 2003, one month after the beginning of the invasion of Iraq. In April 2003, United States forces fired on a group of demonstrators who were protesting against the US presence. US forces alleged they were fired at first, but Human Rights Watch, who visited the site of the protests, concluded that physical evidence did not corroborate US allegations and confirmed the residents’ accusations that the US forces fired indiscriminately at the crowd with no provocation. </em></p>
<p><em>Seventeen people were killed and 70 were wounded.</em></p>
<p><em><strong>Further killings</strong><br />
In a later incident, US soldiers fired on protesters again; Fallujah’s mayor, Taha Bedaiwi al-Alwani, said that two people were killed and 14 wounded. Iraqi insurgents were able to claim the city a year later, before they were ousted by a siege and two assaults by US forces.</em></p>
<p><em>These events caused widespread destruction and a humanitarian crisis in the city and surrounding areas. As of 2004, the city was largely ruined, with 60 percent of buildings damaged or destroyed, and the population at 30–50 percent of pre-war levels.</em></p>
<p><em>At least one US battalion had orders to shoot any male of military age on the streets after dark, armed or not. In violation of the Geneva Convention, the city’s main hospital was closed by Marines, negating its use, and a US sniper was placed on top of the hospital’s water tower.</em></p>
<p><em>On November 13, 2004, a US Marine with 3rd Battalion, 1st Marines, was videotaped killing a wounded combatant in a mosque. The incident, which came under investigation, created controversy throughout the world. </em></p>

<p><em>The man was shot at close range after he and several other wounded insurgents had previously been left behind overnight in the mosque by the US Marines. The Marine shooting the man had been mildly injured by insurgents in the same mosque the day before.</em></p>
<p><em>On November 16, 2004, a Red Cross official told Inter Press Service that “at least 800 civilians” had been killed in Fallujah and indicated that “they had received several reports from refugees that the military had dropped cluster bombs in Fallujah, and used a phosphorus weapon that caused severe burns.”</em></p>
<p><em>On 17 May 2011, AFP reported that 21 bodies, in black bodybags marked with letters and numbers in Roman script, had been recovered from a mass grave in al-Maadhidi cemetery in the centre of the city. </em></p>
<p><em><strong>Blindfolded, legs tied</strong><br />
Fallujah police chief Brigadier General Mahmud al-Essawi said that they had been blindfolded, their legs had been tied and they had suffered gunshot wounds. The Mayor, Adnan Husseini said that the manner of their killing, as well as the body bags, indicated that US forces had been responsible. </em></p>
<p><em>Both al-Essawi and Husseini agreed that the dead had been killed in 2004. The US Military declined to comment.</em></p>
<p>There were no sanctions against the US, UK and Australia, there were no US soldiers, military leaders or politicians held to account. There were no arms sent to help the Iraqis facing overwhelming odds in their fight against the US and its allies.</p>
<p>There were no moves to charge George Bush (US President), Tony Blair (UK Prime Minister) or John Howard (Australian Prime Minister) for war crimes before the International Criminal Court.</p>
<p>Yes Vladimir Putin should be on trial at the International Criminal Court, but before he appears we should have seen George Bush, Tony Blair and John Howard face the same charges first.</p>
<p>We should never forget Bucha &#8212; but we must never forget Fallujah either. The people of both cities deserve justice at the ICC. Let’s do all we can to hold them to account.</p>
<p>Incidentally, US President Joe Biden was pushing hard for the invasion of Iraq back in 2003. His hypocrisy now in condemning Putin is the stuff of legends.</p>
